The Regular Meeting of the Nevada State Board of Nursing was called to order by President Helen Vos, MSN, RN, at 9:05 a.m. on January 24, 2007, at the Palace Station Hotel & Casino, Grand Ballroom, 2411 West Sahara Avenue, Las Vegas, Nevada.

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Board meeting, November 15-16, 2006: Approved under the Consent Agenda.

  2. Contract ratifications: No business.

  3. Conference and seminar report: D. Scott reported on the National Council of State Boards of Nursing’s meetings of the Institute of Regulatory Excellence, of which she is a fellow.

  4. Progress report on FY 06/07 Goals and Objectives: Presentation by D. Scott. Progress related to achievement of Board goals by staff was noted and discussed.

  5. Review of statistics and trends: C. Sansom presented information on Board statistics and trends, including types of scope of practice inquiries received during the previous two months.

  6. Review quarterly financial statements: D. Estes presented the statements and responded to Board member questions. It was moved and seconded to accept the quarterly financial statements. MOTION CARRIED.

  7. Advisory committee liaison assignments: It was moved and seconded to reappoint for another year all current committee liaisons. MOTION CARRIED.

  8. Discussion and feedback regarding the “Guiding Principles for Nursing Regulation”: D. Scott presented the principles, suggesting they be used to guide the Board in setting its goals and objectives. Board members agreed, and suggested that the wording regarding international graduates in principle #2 be moved down to principle #7.

  9. Review, discussion and action regarding concept and wording for proposed regulation revisions for NAC 632.630 Conditional approval: Identification and correction of deficiencies; proof of compliance with Board’s plan; withdrawal of approval; removal from list of approved programs: R. Colosimo gave the background regarding the Board’s Education Advisory Committee’s research into alternate criteria for granting full approval to Nevada nursing education programs. She described the work done by a committee task force that led to the committee’s recommendation to change the regulation’s approval criteria from an annual 80 percent first-time NCLEX pass rate to a first-time pass rate no greater than 10 percent below the national average. R. Colosimo also reviewed national statistics that placed Nevada’s average first-time NCLEX pass rates in 2004 at 39 out of 50, in 2005 at 50 out of 50, and in 2006 at 45 out of 50. M.A. Lambert described the reasoning of the committee regarding meeting the challenge of doubling enrollment while still graduating qualified, competent students, especially in the case of new schools. H. Vos suggested the Board consider changing the regulations only as they relate to new programs. D. Begley expressed concern regarding lowering standards. H. Vos added that the provisional and conditional approval process now in place has produced excellent revisions of programs—something required when programs fall below the annual 80 percent NCLEX first-time pass rate. It was moved and seconded to reject the proposed concept and wording. M.A. Lambert opposed. MOTION CARRIED.

  10. Review and discussion of new publishing agreement for NSBN News: C. Kimball described the agreement by Southern Development & Marketing to publish the Board’s quarterly news magazine, which through its advertisers publishes the magazine at no cost to the Board, providing the magazine free of charge to all active licensees and certificate holders.

  11. Review, discussion and action regarding legislative issues: F. Hillerby, Board legislative liaison, reviewed potential and known issues that the 2007 Nevada Legislature may be considering. He said health care is among the top five issues. F. Hillerby said given the short session, he was requesting Board direction regarding potential bills and its position on certain health care issues. F. Olmstead said the Board’s bill draft request was not processed nor received by the Legislative Counsel Bureau (LCB). D. Scott said that the most recent annual financial audit, conducted after the Board authorized the bill draft request (which included a request to increase the fee range), showed it was currently not necessary to make the request, which had been recommended by the Board’s previous auditor. Board members agreed there was no need to pursue the fee range increase at this time and requested F. Hillerby look into requesting the technical definitional changes in the Board’s bill draft be incorporated into an existing LCB bill draft. F. Hillerby agreed to do so. He then reviewed the history of the introduction of the Nurse Licensure Compact (NLC) legislation in Nevada, adding the Board had reviewed this history at its July meeting and had expressed concerns about the current implementation of the NLC, especially as it relates to fingerprinting and discipline. He also reiterated that the NLC is not a solution to the nursing shortage, as some have misperceived it to be. Board members agreed with his characterization of their previous discussion, and that they do not support moving forward with the current NLC. F. Hillerby described potential legislation regarding mandatory overtime. Board members expressed their concerns about enforcement, setting, and jurisdiction of the Board. F. Hillerby discussed potential numeric staffing ratios legislation. M.A. Lambert said the safe ratio does not depend upon the nurse, but the patient. D. Begley said she fears that the minimum threshold might not be enough. H. Vos asked if there were any new information regarding California’s experience that would indicate whether numeric ratios increase patient safety. D. Scott replied that there are studies that support that view and others that don’t support it. F. Hillerby reviewed the proposal for CNAs to be trained as Medication Aides-Certified (MA-Cs). Board members discussed the current research that shows MA-Cs have safe records as long as they have a clear role in administering medication only with nurse involvement and oversight and proper training. F. Hillerby asked if the setting was of concern. Board members said a nurse would need to be present, as it would be an act of delegation by the nurse to the MA-C. H. Vos asked if the Board could administratively handle the responsibility of certifying and training CNAs to become MA-Cs and what the impact would be. The Board members agreed that if it was assigned to the Board, the Board would need to be directly involved in crafting the authorizing legislation. F. Hillerby described past and current efforts at eliminating temporary licenses due to concerns about background checks, and described how the Board’s screening question and fingerprint checks have assured that almost all applicants with temporary licenses eventually qualify for permanent licenses. He added that the Board is currently compiling data regarding recent experience and has applied for and received a grant to do livescan fingerprinting, but that it hasn’t implemented livescan due to the infrastructure needed by the Nevada Department of Public Safety. Board members agreed that public safety issues include both making sure applicants meet requirements and that they are licensed in a timely manner. D. Scott asked how the Board would like to deal with new legislative issues that might arise during the session. Board members directed that a videoconferenced Board meeting (requiring 72 hours’ notice), be held to discuss any new legislative issues.

  12. Review, discussion and action regarding FY07 proposed budget revisions: D. Estes explained that the addition of new staff in the Reno office necessitated a search for additional space. He added the Board was able to secure an additional 1,100 square feet by moving to the third floor of the current Reno office building. D. Estes and D. Scott responded to Board member questions. It was moved and seconded to approve the revised budget for FY07. MOTION CARRIED.

 

B.     LICENSURE PROGRAMS

1.      Removed.

2.      Review, discussion and action regarding the 2008 NCLEX Test Plan: R. Colosimo reviewed the 2008 NCLEX Test Plan and noted that the word “delegation” is used for LPNs . Delegation is outside the scope of practic of LPNs in Nevada. It was moved and seconded to forward this information related to the 2008 NCLEX Test Plan as feedback to NCSBN. MOTION CARRIED.

3.      Discussion regarding applications for licensure by endorsement: F. Olmstead presented. Board directed him to conduct further research and present the results of that research at a future Board meeting.

4.      Tayamin, Joan Leyderos, RN applicant: Appeal of staff denial based on educational requirements: It was moved and seconded to uphold staff denial of application for licensure. MOTION CARRIED.

9.      Special Action:

a.    Review, discussion and action regarding proposed Violations Based on Renewal Application Audits Policy: The Board directed staff to revise the policy as written and bring to the March 2007 meeting for further discussion and review.

 

E.     EDUCATION

  1. Review, discussion and action regarding applications for the Education Advisory Committee: It was moved and seconded to reappoint Nancy Bridges, RN, CCM, as the representative for the Nursing Institute of Nevada. MOTION CARRIED.

  2. Application for approval for Consolidated Learning Services Nurse Refresher Course. Accepted under the Consent Agenda.

  3. Review, discussion and action regarding Touro University’s application for generic BSN program: R. Colosimo presented the background regarding the application and her analysis that it meets the requirements for offering a BSN nursing education program in Nevada, with the suggestion that it change its numbering system for bachelor-level courses. She stated Touro would offer the generic BSN program in addition to its entry-level MSN-RN program, for which the Board previously granted Touro provisional approval. R. Jones Haley, director of Touro University Nevada School of Nursing, described the proposed BSN program and responded to Board member questions. M.A. Lambert expressed concern that the course numbering for the BSN program was the same as for the entry-level MSN program. She also expressed concern regarding combining the students from the MSN program with the BSN students. R. Jones Haley said the prerequisites would be the same for both the BSN and MSN students, except that the MSN students would be required to have a bachelor’s degree. She added Touro would consider a dual course numbering system. Board members suggested that the course number should be reflective of the academic level of the courses, i.e. a bachelor’s-level numbering (300-400) for prerequisite courses. It was moved and seconded to approve Touro University's proposal to offer a BSN program pending WASC approval and initiating CCNE accreditation process with the following changes: renumbering BSN nursing courses to coincide with academic precedent.. MOTION CARRIED.

 

 

F.      NURSING PRACTICE

  1. Review, discussion and action regarding the proposed revision of the Procedural Sedation Practice Decision: D. Scott presented the background regarding the development of the current practice decision on Procedural Sedation and the factors that led the Nursing Practice Advisory Committee to recommend the proposed revision. Dr. Jonathan Zucker, president of the Nevada State Society of Anesthesiologists (NSSA) presented written testimony requesting a modification of the decision to list propofol as a restricted drug to allow IV-push to a non-ventilated patient only by an anesthesia practitioner. He responded to Board member questions, including how the NSSA recommendation would be implemented in an emergency room setting and why propofol is singled out as a drug of concern. J. Zucker said that propofol can cause deep sedation and general anesthesia, and therefore, requires more safety measures and practitioner training than those drugs that cause moderate sedation. He added that the physicians who are performing the procedures are not necessarily trained in cardiovascular resuscitation and airway management. H.Vos said that the Board’s practice decision requires nurses to have the knowledge, skill, and ability to administer the sedation and anesthetic agents, as well as the qualifications to rescue patients whose level of sedation is deeper than intended, or those who enter a state of general anesthesia. Board members discussed the settings in which the procedure is taking place and the availability of emergency equipment and backup personnel for airway management. It was moved and seconded to accept the proposed practice decision with the following revision: add “on-site” to the phrase, “immediately availability of on-site backup personnel . . . and emergency equipment.” MOTION CARRIED.
