CALL TO ORDER

The Regular Meeting of the Nevada State Board of Nursing was called to order by the President, Patricia Shutt, LPN, at 9:00 a.m. on January 21, 2004, at the Nevada State Museum and Historical Society, 700 Twin Lakes Boulevard, Las Vegas, NV  89107

APPROVAL OF CONSENT AGENDA

It was moved and seconded the Board approve the Consent Agenda, identified as items:  C.1.c, D.2.b-n, D.2.p-s, D.2.u-w, D.3.a-c, D.7.a-c, D.8.f.   MOTION CARRIED.

 

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Board meeting, November 19-21, 2003:  Approved with the following amendment:  M.A. Lambert recused on D.5.i.  MOTION CARRIED.

  2. Legislative Update:  Oral presentaion by F. Hillerby regarding current legislative issues and possible upcoming issues.

  3. Advisory committee liaison assignments:  It was moved and seconded the Board appoint D. Burgio as liaison to the Advanced Practice Advisory Committee, H. Vos as liaison to the Nursing Practice Advisory Committee, D. Perkins as liaison to the CNA Advisory Committee, C. Bible as liaison to the Disability Advisory Committee, and M.A. Lambert as liaison to the Education Advisory Committee.  MOTION CARRIED.

  4. Discussion and direction regarding Advisory Committee to Subcommittee formed pursuant to Assembly Bill 313:  Oral presentation by D. Scott and F. Hillerby.  Assembly Bill 313 mandated a study regarding health care staffing ratios.  Nurse staffing requirements are currently based on a registered nurse assessment of patient acuity as mandated by NRS 449.  A subcommittee of the Interim Healthcare Committee has been tasked to review the issue and bring forth recommendations.  An Advisory Committee to the subcommittee, of which D. Scott is a member, has been developed to assist in this process.  The subcommittee report of recommendations is due in June 2004.     

  5. Review statistics and trends:  Oral presentation by R. Buck, C. Sansom, and D. Scott.  A comparison of 2002 and 2003 data indicates there has been a slight decline in the complaint rate for CNA certificate holders – 2.4% to 1.81%.  The complaint rate for nurses remained at 0.9%.  There are a total of 29 participants in the Alternative Program for Chemically Dependent Nurses, and a total of 101 participants on probation. The Board president requested that recidivism rates related to discipline be included annually.  

  6. Progress report on FY 03/04 Priorities:  Oral report by D. Scott and D. Rennie.  Relocation of the Las Vegas Office has been completed.  On line renewal for RN and LPN licensure is in the beta testing phase with implementation anticipated for processing April 2004 renewals.  All CNA-related fee increases have been implemented.  The new NSBN magazine is currently at the publisher; quarterly publication is anticipated.  Distribution will be to all licensed and certified individuals, nursing students, healthcare facilities and other key stakeholders.    

  7. Contract ratification:  No business.

 

B.     LICENSURE PROGRAMS: 

  1. Proposed policy revision:  Licensure Renewal for RN and LPN:  It was moved and seconded the Board approve policy as amended.   MOTION CARRIED.

 

C.     CERTIFICATION PROGRAMS

  1. Nursing Assistant

    1. Discussion and clarification regarding renewal hours requirement:  It was moved and seconded the Board continue the renewal requirements of 400 hours of employment in the CNA scope of practice and 24 contact hours of continuing education.  In addition, the renewal application will be revised to incorporate the approved CNA skills list.  MOTION CARRIED.

    2. Appointment of member(s) to CNA Advisory Committee:  It was moved and seconded the Board table this item for additional information, until the March 2004 Board meeting.  MOTION CARRIED.

    3. Approval of Annual CNA Program Report for Federal Fiscal Year 2003:  Approved under the Consent Agenda. 

 

  1. Advanced Practice

    1. Appointment of member(s) to APN Advisory Committee:  It was moved and seconded the Board appoint Sheri Aikin, MS, RN, APN.  MOTION CARRIED.

 

D.    DISCIPLINE PROGRAMS

1.      Applications (initial and renewal) in question:

a.       Carmody, Mary, RN Applicant: This matter was continued to allow the applicant to have a Disability Advisory Committee evaluation and be present when her application is presented to the Board.

b.      Coonradt, Ila, RN Applicant: Applicant was present. It was moved and seconded the Board accept the application for licensure. MOTION CARRIED.

It shall be the responsibility of the applicant to use her nursing judgment to practice safely in accordance with her limitations.  Unsafe practice is considered unprofessional conduct and is subject to Nevada Revised Statutes (NRS) Chapter 632.  MOTION CARRIED.

f.        Martinez, Abel, RN Applicant: It was moved and seconded the Board accept the application for licensure.  MOTION CARRIED.

To remove the suspension, Respondent must have an evaluation by the Board’s Disability Advisory Committee and enroll in the Board’s drug screening program. Respondent must complete a drug screen prior to her appointment with the Disability Advisory Committee.  Any recommendations by the Disability Advisory Committee must be presented to the Board for further review and possible action. If the Committee does not have any recommendation and Respondent has met all the other criteria for removal of suspension, Respondent’s certification is to be placed on probation for a minimum of three (3) years. l.         Sawaya, Jo, RN07790:  Respondent was present with counsel.  It was moved and seconded the Board accept the Agreement for Probation which includes the stipulation that the license be suspended pending completion of certain requirements for violation of NRS 632.320 (7) unprofessional conduct and NAC 632.890 (21) obtaining, possessing a prescription drug, except as authorized and (26) failing to abide by any state or federal statute or regulation relating to the practice of nursing. m.     Schwartz-Kranich, Sharon, LPN11144:  It was moved and seconded the Board find the Respondent guilty of one count of NRS 632. 320 (7) unprofessional conduct and NAC 632.890 (22) patient abandonment. It was moved and seconded the Board revoke Respondent’s license.  Respondent may not apply for reinstatement for a period of one (1) year.  It was moved and seconded the Board order the disciplinary action become part of the Respondent's permanent record and be published and reported to all appropriate agencies. It was moved and seconded the Board revoke Respondent’s license. Respondent may not apply for reinstatement for a period of two (2) years.  It was moved and seconded the Board order the disciplinary action become part of the Respondent's permanent record and be published and reported to all appropriate agencies.  Pursuant to NRS 632.325(1)(c), it was moved and seconded the Board charge the Respondent with the actual attorney fees and costs of this hearing, which are payable within one hundred twenty (120) days from issuance of the actual costs. p.      Valdez, Lolita, CNA011687:  It was moved and seconded the Board find the Respondent guilty of NRS 632. 320 (7) unprofessional conduct, (13) deceive, defraud or endanger a patient or the general public and NAC 632.890 (17)(a) soliciting or borrowing money from a patient and (34) misappropriating property of a patient. It was moved and seconded the Board revoke Respondent’s certificate.  Respondent may not apply for reinstatement for a period of ten (10) years. It was moved and seconded the Board order the disciplinary action become part of the Respondent's permanent record and be published and reported to all appropriate agencies.  Pursuant to NRS 632.325(1)(c), it was moved and seconded the Board charge the Respondent with the actual attorney fees and costs of this hearing, which are payable within one hundred twenty (120) days from issuance of the actual costs. q.      Hughes, Joyce, CNA012722: Respondent was present. 9.      Special Action:

a.       Approval of application for Aftercare/Outpatient Providers:  It was moved and seconded the Board approve Carol Schay-Viegener, RNC, LADC, as an Aftercare/Outpatient Provider.  MOTION CARRIED.

b.      Christoph, Karin, RN applicant, appeal of denial of RN licensure by examination:  Tabled for further information to the March 2004 Board meeting.

c.       Alvarado, Richard, RN32899:  It was moved and seconded the Board reinstate Respondent’s license.  MOTION CARRIED.

E.     EDUCATION

  1. Discussion of CA BRN action related to Excelsior College:  Oral presentation by D. Rennie.  The California Board of Registered Nurses voted to limit licensure of Excelsior graduates.  Beginning December 6, 2003, individuals who enroll in Excelsior and seek California licensure must have previously been an LVN/LPN and have met the California requirement for clinical experiences.  Communication with Excelsior College indicates it is in the process of reviewing its political and/or legislative options related to this decision.  Board directed staff to continue to monitor the situation between Excelsior College and the California Board of Registered Nurses and to provide periodic updates.     

  2. Proposed curriculum changes – CCSN:  Presentation by Lisa Kless-Kern, RN, CCSN Program Director.  It was moved and seconded the Board approve the proposed curriculum changes as presented.  MOTION CARRIED.

  3. Discussion of MD to BSN education programs:  Oral presentation by D. Rennie.  The Republic of the Philippines Commission on Higher Education has developed strict guidelines for nursing programs conducting MD to BSN nursing education.  The student must complete specific nursing courses to include mandated theoretical instruction and clinical experiences equivalent to upper level nursing courses.  Credit is awarded for science and social science course work completed in the previous degree.   Information about these programs was obtained from the Commission, individual nursing programs, and CGFNS.  Graduates of these programs have a slightly higher first time pass rate on NCLEX than their non-MD peers.  Florida International University has been tasked to develop an MD to ADN program for non-US trained physicians residing in that state.  Staff will continue to monitor these programs and report to the Board as appropriate.    

  4. Appointment of member(s) to Education Advisory Committee:  It was moved and seconded the Board appoint Nancy Bridges, RN, CCM; Mae Cherry, MSN, RN; and Connie Carpenter, EdD, RN.  MOTION CARRIED.

  5. Discussion of proposal by UCCSN regarding nursing faculty requirements:  Oral presentation by Jane Nichols, Chancellor, UCCSN.   The legislative requirement to double nursing program enrollment is also creating a need for additional nursing faculty.  Because resources are limited, creative ways must be sought to increase the number of faculty without compromising quality.  Faculty education requirements vary throughout the country.   The proposal presented included consideration of clinical faculty with a BSN degree while working towards a graduate degree in nursing.  Discussion ensued regarding other options that include faculty with a BSN and a master’s degree in a related field.  It was noted the Board’s Education Advisory Committee has been charged to review options and make recommendations specifically related to the faculty education requirements established by Nevada Administrative Code.  An open invitation was extended to the Chancellor, or her representative, to attend and participate in the committee’s discussions.

F.      NURSING PRACTICE

  1. Review of proposed practice decision regarding SANE:  Oral presentation by D. Scott who reviewed the proposed Sexual Assault Nurse Examiner practice decision.  Jodi Tyson, Director of the Coalition Against Sexual Violence, expressed the support of CASV and  the Washoe County District Attorney’s office for the current draft.  The proposed decision was referred to the March 2004 Board meeting to provide an opportunity for further testimony from stakeholders in Northern Nevada.
