CALL TO ORDER

The Regular Board Meeting of the Nevada State Board of Nursing was called to order by the President, Patty Shutt, LPN, at 9:05 a.m. on January 22, 2003 at the Grant Sawyer Building, Capitol Police Conference Room 1100, 555 E. Washington, Las Vegas, NV  89101.

OPEN FORUM

Mrs. Culpepper addressed the Board on behalf of her son, Charles R. Culpepper, RN.  She related to the Board her son’s nursing licensure history that began in 1989.  She requested the Board grant him an unrestricted license in order for him to pursue his goal of nursing on a missionary ship.

 

APPROVAL OF CONSENT AGENDA

It was moved and seconded to approve the Consent Agenda, identified as items:  A.1, C.1.a, D.2 a-d, f-h, k-o, q, D.3.a-f.  H. Vos recused on D.2.d.   MOTION CARRIED.

 

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes from Regular Board meetings for October 29-30, 2002 and Amended Minutes for September 18-20, 2002:  Approved under the Consent Agenda.  MOTION CARRIED.

  2. Discussion of Annual Retreat: Oral presentation by D. Scott.  Research on possible locations was presented.  The Executive Director was advised to seek additional information on David Walley’s, Genoa, Nevada.

  3. National Council of State Board of Nursing

    1. Certificate presentation:  Presentation, by D. Scott, to Bobbye Hicks, Senior Licensure Specialist, for her work on the National Council of State Boards of Nursing Technical Services Subcommittee.

    2. Oral report from National Council of State Boards of Nursing Patient Safety Summit:  Oral presentation by C. Bible.  The array of excellent speakers discussed numerous patient safety issues such as the IOM study on medical errors and other health-related safety concerns.  The summit will be repeated this year then biennially thereafter.

  4. Oral report from CAC Annual Conference:  Oral presentation by C. Bible and C. Kimball.  It was noted a major focus of the conference was the desire for consumers to have greater input into the health care and nursing care they receive.  Bridging nursing education to nursing practice was also considered a major concern. 

  5. Progress report on FY priorities: Oral presentation by D. Scott, D. Rennie, C. Kimball and E. Lopez-Bowlan.  The progress reports of October 1-November 30, 2002 that have been incorporated into the existing document were discussed.  E. Lopez-Bowlan and C. Kimball discussed the Spanish-speaking outreach program and actions completed to date.  The Board’s established priorities have also been reflected in Board staff performance tools and evaluations.

  6. Statistics and trends:  Oral presentation by D. Scott.  The report highlights selected statistics and trends related to the work of the Board.  Specific reporting periods have been established for different categories of statistics.  The report for the period of October 1-November 30, 2003 encompassed information on questions related to the topics of practice, staffing and discipline received by Board staff.

  7. Installation of Officers:  The outgoing Board officers of 2002 (C. Bible, President, P. Shutt, Vice President, and M. Lambert, Secretary) introduced themselves and passed their respective positions to the incoming officers of 2003 (P. Shutt, President, M. Lambert, Vice President, and H. Vos, Secretary). 

  8. Legislative update:  Oral presentation by K. Marcher and F. Hillerby.  The 2003 legislative session will have four new senators and 16 new assemblymen.  Hillerby discussed the focus of the legislative session and informed the Board its bill drafts related to mutual recognition and approval/accreditation of nursing schools have been submitted.  Hillerby suggested when speaking with legislators or legislative staff members, it is important for Board members to distinguish their positions on issues in their role as a Board member versus an individual role. 

  9. Discussion of Bill Draft Request 15-826, Enhance criminal penalty for assault of health care worker:  Oral presentation by S. Rush.  The current draft legislation will be applicable to 35 categories of health care workers.  There does not appear to be any opposition to this expansion of protection that is already afforded to other categories of workers, e.g., police, firemen, taxi cab drivers and bus drivers.  It was moved and seconded the language of BDR 15-826 be reviewed by the Board President, Senior Deputy Attorney General, and Legislative Liaison.  If the language is found appropriate, the Board will send a letter of support for the legislation to S. Rush.  MOTION CARRIED.

  10. Financial statements October 1, 2002 through December 31, 2002:  Oral presentation by D. Scott.  Various financial line items were discussed. It was noted budgetary expenses are within the projections for the completion of the first two quarters of FY 2002/2003. 

  11. Discussion of UCCSN doubling enrollment plan:  Oral presentation by D. Begley, RN, Nurse Executive, Nursing Institute of Nevada, Nevada Hospital Association.  A review of the plan’s history and methods of supporting data were discussed.  It was noted that the plan may not double enrollment at each campus but seeks to double the total number of nursing students system-wide.  A handout was provided summarizing the faculty-student ratios of other boards of nursing.  This information was presented to the Board and discussed in relation to the supporting data of the doubling enrollment plan.  NHA supports the current ratio of 8 students to 1 faculty and Ms. Begley noted some hospitals prefer an even lower faculty-student ratio to promote patient safety. 

  12. Access to Public Information Policy proposed revision:  Oral presentation by D. Scott.  Based on NRS 632.405, 629.061 and 239.012, there is a need to revise the existing policy, specifically to protect licensee/certificate holder confidentiality and privileged information from disclosure to the public.  It was moved and seconded to approve the proposed policy as written.  MOTION CARRIED.

  13. Discussion of Fingerprint Policy and Extension of Temporary License for Certificate:  Oral presentation by D. Rennie.  Fingerprint processing fees paid to the Nevada Criminal Repository will increase from $39 to $45 on February 3, 2003.  Numerous licensure and certification applicants will be affected by this increase.  It was moved and seconded to approve staff recommendations for revisions to the policy on extension of temporary licenses/certificates and the policy on fingerprinting.  MOTION CARRIED.

a.       Collins, Jodari, CNA applicant:  Applicant was present. It was moved and seconded the Board ratify the staff denial of the application for certification for violation of NRS 632.320 (1) fraudulent application. MOTION CARRIED.

b.      Donnelly, Shirley, CNA applicant: It was moved and seconded the Board ratify the staff denial of the application for certification for violation of NRS 632.320 (1) fraudulent application. MOTION CARRIED.

c.       Hiatt, Jenith, RN applicant: It was moved and seconded the Board ratify the staff denial of the application for licensure for violation of NRS 632.320 (1) fraudulent application. MOTION CARRIED.

b.      Price, Timothy, CNA002077: It was moved and seconded the Board ratify the staff denial of the application for certification, based or violation of NRS 632.320 (2) convictions and order the denial become part of the Respondent’s permanent record and be published and reported to all appropriate agencies based on NRS 632.320 (2) convictions. MOTION CARRIED.

c.       Rusher, Kelly, RN applicant: It was moved and seconded the Board overturn the staff denial and accept the application for licensure. MOTION CARRIED.

  1. Special Action:

    1. Policy related to NRS 632.320 (7)(e):  It was moved and seconded the Board accept the “Yes Answer Regarding Malpractice” policy with suggested changes. MOTION CARRIED.

 

E.     EDUCATION

  1. Update of Education Advisory Committee:  Oral presentation by D. Rennie

  2. Nursing Schools

a.       UNLV Nursing Program:  Oral presentation by D. Rennie.  A survey of the nursing program was conducted on November 12-13, 2002 by D. Rennie and P. Ratliff, MS, RN, Education Consultant, New Mexico State Board of Nursing.  Dr. R. Witt responded to questions from Board members.  It was moved and seconded to grant full approval to the Nursing Program of the University of Nevada, Las Vegas for the next four (4) years.  MOTION CARRIED.

b.      UCLA Harbor FNP Program:  Removed from the agenda per request of the submitter.

 

F.      NURSING PRACTICE

  1. Proposed practice decision regarding cosmetic procedures:  Oral presentation by D. Scott.  It was moved and seconded to adopt the proposed practice decision with the following revision:  add to #7 “physician who has the knowledge, skill, and abilities to perform the procedure, who is present at the site where the procedure is performed.”  MOTION CARRIED.
