The Regular Meeting of the Nevada State Board of Nursing was called to order by President Helen Vos, MSN, RN, at 9:00 a.m. on January 25, 2006, at the Palace Station Hotel & Casino, Grand Ballroom-2nd floor, 2411 West Sahara Avenue, Las Vegas, NV 89102.

CALL TO ORDER – 9:00 a.m.

 

PUBLIC COMMENT: Martha Drohobyczer, MSN, RN, APN, CNM, stated that in her role as a member of the Nevada Nurses Association’s Special Practice Group/Advanced Practitioners of Nursing (SPG/APN), she was informing the Board of her group’s intent to go forward with a request that the 2007 Nevada Legislature pass a bill granting independent practice to APNs. She cited 40 years of safe APN practice and the need for greater patient access to health care services as two major reasons to support such legislation.

 

Sharon Akes-Cave, MSN, RN, BC, nursing education coordinator for Pima Medical Institute in Las Vegas, described Pima’s plans to request future Board approval to establish a nursing education program in Las Vegas.

  4. Conference and seminar report: D. Scott reviewed the topics discussed at the January 2006 National Council of State Boards of Nursing Institute of Regulatory Excellence seminar, which included continued competence and evidence-based practice. J. Cortez reported on his attendance at the Citizen Advocacy Center annual meeting.

  5. Progress report on FY 05/06 Goals and Objectives: Presentation by D. Scott. Progress related to achievement of Board goals by staff was noted and discussed.

  6. Review statistics and trends: C. Sansom presented information on Board statistics and trends, including types of scope of practice inquiries received during the previous two months.

  7. Review quarterly financial statements: D. Estes and D. Scott presented the Board’s quarterly financial statements and responded to Board member questions.

  8. Advisory committee liaison assignments: It was moved and seconded to approve the following advisory committee liaison assignments: Advanced Practice Advisory Committee—David Burgio; CNA Advisory Committee—Dorothy Perkins; Disability Advisory Committee—Doreen Begley; Education Advisory Committee—Mary Ann Lambert; and Nursing Practice Advisory Committee—Betty McKay.   9. Review, discussion and action regarding concept and wording for proposed regulation revisions for:

a.       NAC 632.500    Authorized functions: It was moved and seconded to accept the concept, with the wording to be revised by the Advanced Practice Advisory Committee per the Board’s discussion. MOTION CARRIED.

b.      NAC 632.530    Certificate of recognition:  Issuance; restrictions: It was moved and seconded to accept the concept and wording as written. MOTION CARRIED.

c.       NAC 632.540    Certificate of recognition:  Expiration; renewal: It was moved and seconded to accept the concept and wording as written. MOTION CARRIED.

d.      NAC 632.545    Certificate of recognition:  Expiration due to lapse in practice: It was moved and seconded to accept the concept and wording with the following changes: delete the word “substantial” and delete the term “lapse in practice” and refer to the definition of minimum practice in sections 2-5. e.       NAC 632.550    Certificate of recognition:  Revocation, suspension or denial of issuance or renewal: It was moved and seconded to accept the concept, with the wording to be revised by the Advanced Practice Advisory Committee per the Board’s discussion. MOTION CARRIED.

  1. Review, discussion and action regarding FY ’06 Budget Revision: D. Estes reviewed the budget revision, explaining that it reflected the approved salary plan for compression, as well as personnel changes. It was moved and seconded to approve the FY ’06 Budget Revision. MOTION CARRIED.

  2. Update on the Criminal History Background Check Pilot Program Steering Committee and possible action regarding the Electronic Fingerprinting Rebate Plan: D. Scott presented background information and a request to submit a proposal letter to apply for a grant to purchase “LiveScan” equipment. D. Estes discussed equipment options and the budget revision that would be required to cover expenses not provided by the grant. D. Estes and D. Scott responded to Board member questions. Board members directed staff to apply for an equipment grant for both the Reno and Las Vegas Board offices.

 

B.     LICENSURE PROGRAMS

1.      Review, discussion and action regarding the 2007 NCLEX Test Plan: D. Cowling gave historical background, described current proposed changes, and responded to Board member questions. It was moved and seconded to submit the comments as written to NCSBN 2007 NCLEX Test Plan. MOTION CARRIED.

 

C.     CERTIFICATION PROGRAMS

1.      Ratification of NSBN Staff Survey of the Nursing Assistant Training Program—Manor Care, Reno: Approved under the Consent Agenda.

p.   Whitney, Shirley, RN25107:  Respondent was present with counsel.  It was moved and seconded the Board find the Respondent guilty of violating NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (11) positive drug screen as condition of employment.  It was moved and seconded the Board order the Respondent be reprimanded and complete a Board-approved course on legal ethics in nursing within one year.  It was moved and seconded the Board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.  Pursuant to NRS 622.400 it was moved and seconded the Board charge the Respondent with the actual attorney fees and costs of the hearing, which are payable within one hundred twenty (120) days from issuance of the actual costs.  MOTION CARRIED.

It was moved and seconded the Board ratify the staff denial of the application for certification for violation of NRS 632.320 (1) fraudulent application, and order the denial become part of the applicant’s permanent record and be reported to all appropriate agencies.  In addition, should the applicant reapply within the next 30 days and the application has no material changes, Board staff may accept the application for further processing.  MOTION CARRIED.

Cowling presented an overview and history of the Board’s provisional approval of the Nevada State College (NSC) Nursing Program. Connie Carpenter, EdD, RN, director of the NSC Nursing Program, gave a 6-month report on the status of the program, including the number of students who have graduated, their NCLEX scores, and steps taken to improve the NCLEX scores. Dr. Carpenter responded to Board member questions regarding recruitment and retention of faculty, admission requirements, and clinical sites. It was moved and seconded to grant continuing provisional approval to the Nevada State College Nursing Program. MOTION CARRIED.

  3. Review, discussion and action regarding Southern Utah University Department of Nursing request to utilize clinical placement in Nevada medical facility: D. Cowling presented a brief overview of the request. Dr. Karla Dalley, RN, described the Southern Utah University Department of Nursing’s education program and explained that the request to place students in a Nevada medical facility would utilize clinical space only on nights and weekends. Board members expressed concern that if the request was granted without the program undergoing the Board’s nursing education approval process, there was no way to monitor whether the Southern Utah University Department of Nursing was restricting its student clinical placements in Nevada medical facilities to nights and weekends. It was moved and seconded to deny the Southern Utah University Department of Nursing request to utilize clinical placement in Nevada medical facility. MOTION CARRIED.

  4. Review, discussion and action regarding applications for the Education Advisory Committee: It was moved and seconded to appoint Lisa Black, MS, RN, as the Nevada Nurses Association representative to the Education Advisory Committee. MOTION CARRIED.

F.      NURSING PRACTICE

  1. Review, discussion and action regarding applications for the Advanced Practice Advisory Committee: It was moved and seconded to reappoint Patricia Brown, MSN, RN, APN, to the Advanced Practice Advisory Committee. MOTION CARRIED.

  2. Review, discussion and action regarding LPNs giving rectal medication in the school setting: D. Scott described the research and discussion that led to this recommendation by the Nursing Practice Advisory Committee. B. McKay stated as an LPN who works in the school setting, she believed the recommendation would increase access to nursing care without compromising patient safety. It was moved and seconded to revise the School Nurse Advisory Opinion Delegation Grid to allow LPNs to administer rectal medication in the school setting. MOTION CARRIED.

  3. Applications in question regarding NRS 632.307:

a.   Swanson, Ingrid, RN32477 renewal applicant. Applicant was not present. The Board accepted the application for licensure and issued a license with limitations pursuant to NRS 632.307.  Accepted under the Consent Agenda.

  1. Review, discussion and action regarding the Apprentice Nurse Skills List: D. Scott explained that the RN and LPN Apprentice Nurse Skills Lists had been combined and reformatted for greater clarity and ease of use. It was moved and seconded to accept the reformatting of the Apprentice Nurse Skills List. MOTION CARRIED.
