CALL TO ORDER

The Regular Meeting of the Nevada State Board of Nursing was called to order by the President, Patty Shutt, LPN, at 9:00 a.m. on June 18, 2004 at Meadow Wood Courtyard, 5851 S. Virginia Street, Tahoe Room A, Reno, Nevada  89502

APPROVAL OF CONSENT AGENDA

It was moved and seconded to approve the Consent Agenda, identified as items: A.1, D.1.a-b, and D.2.a.  M.A. Lambert recused herself on D.1.a.   MOTION CARRIED.

 

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Board meeting, May 19-21, 2004:  Approved under the Consent Agenda.

 

  1. Public Hearing-Notice of Intent to Adopt Regulations:  

NAC 632.257, NAC 632.455, NAC 632.600, NAC 632.605, NAC 632.620, NAC 632.645, NAC 632.665, NAC 632.670, NAC 632.675, NAC 632.685, NAC 632.690, NAC 632.703, NAC 632.706:  The public testimony received at the public workshops of May 19, 2004 and May 24, 2004, and the one written comment submitted for consideration, was presented to the Board for review.  Additonal testimony was provided by Crystal McGee, Senior Research Analyst, representing the Vice Chancellor of the University and Community College System of Nevada, and by Dr. Patsy Ruchala, Acting Director, Orvis School of Nursing, University of Nevada, Reno.  Each proposed regulation hd been reviewed and edited by the Legislative Counsel Bureau (LCB).  Board member discussion ensued.  It was moved and seconded to add the section to NAC 632 related to accreditation and to accept the changes to NAC 632.257 as written in LCB File R091-04, dated June 14, 2004.  It was moved and seconded to accept the changes to NAC 632.450 and NAC 632.455 as written in LCB File R091-04, dated June 14, 2004.  It was moved and seconded to to accept the changes to NAC 632.605 as written in LCB File R091-04, dated June 14, 2004.  It was moved and seconded to accept the changes to NAC 632.620 as written in LCB File R091-04, dated June 14, 2004.  It was moved and seconded not to accept the changes to NAC 632.645 (2.c.) as written in LCB File R091-01, dated June 14, 2004 and to recommend the use of “accessible to students” rather than “available to students”.  It was moved and seconded to accept the changes to NAC 632.665 as written in LCB File R091-04, dated June 14, 2004.  It was moved and seconded to accept the changes to NAC 632.670 and NAC 632.675 as written in LCB File R091-04, dated June 14, 2004 with exception of (2) to read: “a bachelor’s degree with a major in nursing and a master’s degree in a field related to nursing”.  It was moved and seconded to accept the changes to NAC 632. 685, NAC 632.690, NAC 632.703 and NAC 632.708 as written in LCB File R091-04, dated June 14, 2004.  MOTION CARRIED.

  1. Progress report on 03/04 FY priorities:  Presentation by D. Scott.

  2. Review of statistics and trends:  Presentation by D. Rennie and D. Scott. 

·        Overall, all categories of license and certificate holders have been steadily increasing in volume. 

·        The numbers of applications from international nurses has decreased since implementation of a requirement for outsourced education evaluations.  International nurses seeking licensure by examination in Nevada are primarily educated in the Philippines, India, China and the United Kingdom. 

·        The NCLEX pass rate for international first-time test-takers remains below that of U.S. educated nurses.  First-time test-taker pass rates for Nevada nursing programs are now being monitored on a calendar year basis. 

 

  1. National Council of State Boards of Nursing

a.            Selection of delegates for Delegate Assembly 2004:  It was moved and seconded to appoint P. Shutt and D. Scott as delegates and M.A. Lambert and D. Perkins as alternate delegates.  MOTION CARRIED.

  1. Report from NCSBN Foreign Graduate Subcommittee: Presentation by D. Rennie.  The subcommittee consisted of board of nursing representatives from California, Georgia, Kansas, Kentucky, Nevada and Ohio.  The original charge was to review and revise a previously published NCSBN Resource Manual for Licensure of International Nurses.  The charge was amended to include the development of the minimum data sets for the evaluation of international nursing education by boards of nursing and credential evaluation agencies.  The committee met four times between February and June 2004.  The work product will be presented to the NCSBN Delegate Assembly meeting in August 2004.

  2. Oral report from NCSBN/Promissor Unlicensed Assistive Personnel conference of June 12, 2004:  Presentation by D. Rennie.  The purpose of the conference was to discuss the practices of state nurse aide registries, research related to UAP practices, background check processes, and direction of UAP practice.  Presenters included representatives of the U.S. Department of Health and Human Services; Office of the Inspector General; Office of Evaluation and Inspections; Criminal Investigation Unit of the New Jersey Department of Health and Senior Services; National Council of State Boards of Nursing; and various state regulatory agencies.  Presentations showed that UAP practice is expanding into a variety of health care professions as personnel shortages increase.  Regulation of UAP practice and nursing responsibility related to that practice varies from state to state.  It was also noted that differences exist among state agencies with respect to monitoring and regulating UAP practice.

  1. Settlement Agreements:

a.       Miller, Colleen, RN33560: Respondent was present. Agreement for Monitoring pursuant to NRS 632.320 (5) use of controlled substance, dangerous drug or intoxicating liquor. M.A. Lambert recused herself. Accepted under the Consent Agenda.

b.      Longland, Wynema, RN09061:  Voluntary Surrender of License in Lieu of Other Disciplinary Action by the Board pursuant to NRS 632.320 (7) unprofessional conduct and NRS 632.320 (14) violation of an order of the Board. Accepted under the Consent Agenda.

  1. Completion of probation:

a.       Schlachter, Jennifer, RN19361: Termination of Probation accepted under the Consent Agenda.

  1. Applications (initial and renewal) in question:  No business.
