The Regular Meeting of the Nevada State Board of Nursing was called to order by President Helen Vos, MSN, RN, at 9:03 a.m. on March 29, 2006, at the Meadow Wood Courtyard, 5851 S. Virginia Street-Tahoe Room A, Reno, Nevada, 89502.

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Regular Board meeting, January 25-27, 2006: Approved under the Consent Agenda.

  2. Progress report on FY 05/06 Goals and Objectives: Presentation by D. Scott. Progress related to achievement of Board goals by staff was noted and discussed.

  3. Contract ratifications: Hillerby & Associates: Approved under the Consent Agenda.

  4. Conference and seminar report: H. Vos, D. Begley, D. Scott, and F. Olmstead reported on the National Council of State Boards of Nursing (NCSBN) Mid-Year Meeting, which included media training for Board presidents, joint meetings with directors of medical examiners and nursing boards regarding opportunities to collaborate, the future of regulation, competency measurement, scopes of practice, advanced practice, reorganization of NCSBN governance and leadership, and hurricane recovery. D. Begley reported on her attendance at Preparing America for an Influenza Pandemic: A National Forum for State Leaders, Henderson, Nevada. C. Sansom reported on her attendance at a NCSBN Nursys conference regarding the national collection and dissemination of licensure and discipline data.

  5. Review statistics and trends: C. Sansom, R. Buck, and K. Reynolds presented information on Board statistics and trends, including types of scope of practice inquiries received during the previous two months, and discipline and compliance statistics for the past six months.

  6. Report from legislative liaison-Fred Hillerby: Fred Hillerby reported on the activities of the Interim Legislative Health Care Committee, possible 2007 legislation, and candidates for the 2006 election.

  7. Update from Thomson Prometric-CNA testing company: Jan Jones-Schenk, Thomson Prometric representative, presented reports regarding CNA knowledge and clinical examinations and responded to Board member questions and suggestions for reporting refinements.

  8. Review, discussion and action regarding concept and wording for proposed regulation revisions for:

    1. NAC 632.020   “Advanced practitioner of nursing” defined.

    2. NAC 632.039   “Nurse midwife” defined.

    3. NAC 632.062   “Nurse psychotherapist” defined.

    4. NAC 632.072   “Protocol” defined.

D. Scott and D. Burgio presented the research and discussion in the Advanced Practice Advisory Committee that led to the committee’s recommendation to revise the above regulations. Phyllis Suiter, MA, RN, APN, a committee member, added background and historical information. Proposed regulation revisions were discussed individually. Board members requested the phrase “registered professional nurse” replace the phrases “registered nurse” and “professional nurse,” in all instances where they appear in the above regulations. Scott Craigie, lobbyist for the Nevada State Medical Association, and Dr. Jerry Matsumara, president of the Nevada State Society of Anesthesiologists, gave testimony in opposition to the proposed revisions to NAC 632.500 and NAC 632.550. Craigie asked the Board to consider the change requests in statute rather than regulation. F. Olmstead agreed changing the regulations would require a statute change. D. Scott clarified that the proposed revisions to NAC 632.500 and NAC 632.550 would not change the CRNA’s role or relationship with a directing or supervising physician. It was moved and seconded to accept the agenda items A.8.a. through A.8.r with the changes discussed. MOTION CARRIED.

s.       NAC 632.640     Requirements for approval.

D. Cowling stated the intention of the Education Advisory Committee recommendation to revise the regulation was to make it more inclusive. M. A. Lambert suggested adding “leading to initial licensure” to be consistent with the Board’s decision regarding its jurisdiction over nursing education programs. After further discussion, the Board directed staff to take the entire education section of Nevada nursing regulations back to the Education Advisory Committee for recommendations for revision.

t.        NAC 632.746      Instruction in basic nursing skills.

C. Sansom and D. Perkins presented the CNA Advisory Committee recommendation to revise the above regulation to reflect the CNA Model Curriculum as well as current practice, and to add language allowing CNAs to report and record information. It was moved and seconded to accept the concept and wording as written. MOTION CARRIED.

  1. Review, discussion and action regarding fee range increase for 2007. D. Estes stated the 2005 auditor’s report showed expenditures outpacing revenue. D. Scott explained that the Board would ask for a statutory revision to increase the fee range in 2007, but would have no immediate plans to introduce regulatory increases. She added the Board needs to be prepared so it can ensure it does not run into a deficit position. She further stated that the Board has not raised nursing fees for 12 years. D. Estes described ways the Board has saved expenditures, especially through the use of technology. However, demand for services continues to increase. Board members directed the executive director to develop a bill draft request for the 2007 legislative session.

 

B.     LICENSURE PROGRAMS: No business.

 

C.     CERTIFICATION PROGRAMS

1.      Review, discussion, and action regarding Nevada Care Nursing Institute application to provide a Nursing Assistant Training Program: D. Cowling gave background and history of the application. Nevada Care Institute representatives Monica Abarro and Jacinto Marcelo discussed their application and responded to Board member questions. It was moved and seconded to approve the Nevada Care Nursing Institute’s application to provide a Nursing Assistant Training Program. MOTION CARRIED.

2.      Ratification of NSBN Staff Survey of the Nursing Assistant Training Program, Great Basin College: Approved under the Consent Agenda.

3.      Review, discussion and action regarding changing NRS 632.2856 to increase CNA training program hours: C. Sansom described the research and discussion by the CNA Advisory Committee that led to their recommendation to increase the number of hours required for CNA training programs from 75 hours to 120 hours. She said the recommendation was based on several factors: an Office of the Inspector General study which found that nurse aide training, training hours, clinical hours, and teaching methods do not meet current patient needs; the amount of instruction that needs to be accomplished; and the current number of hours in Nevada’s 21 nursing assistant training programs (13 require more than 120 hours, five require more than 100 hours, and three require less than 100 hours). M. A. Lambert recommended that the revision read “no less than 120 hours.” It was moved and seconded that the Board request a statutory revision of NRS 632.2856 as written except for the addition of “no less than.” MOTION CARRIED.

4.      Report regarding revised CNA Skills Guidelines: C. Sansom provided the background and history of the guidelines, which were developed based on the CNA Model Curriculum. Upon the recommendation of the CNA Advisory Committee, the guidelines were reformatted to mirror the model curriculum. To increase clarity, the “Examples of Tasks Not Within the Scope of a CNA” were deleted.

 

D.    DISCIPLINE PROGRAMS

Applicant must complete the Nevada Nurse Practice Act course, a course on professional nursing accountability and liability, and pay in full the remaining balance of the citations issued by the Board prior to the first renewal of Nevada licensure.  MOTION CARRIED.

b.   Dela Pena, Lorna, RN applicant: Applicant was not present. It was moved and seconded the Board continue this matter to the May 2006 Board meeting.

It was moved and seconded the Board ratify the staff denial of the application for licensure for violation of NRS 632.320 (1) fraudulent application, and order the denial become part of the applicant’s permanent record and be reported to all appropriate agencies.  In addition, should the applicant reapply within the next 30 days and the application has no material changes, Board staff may accept the application for further processing.  MOTION CARRIED.

E.     EDUCATION

  1. Review, discussion and action regarding Orvis School of Nursing program report and approval: D. Cowling reviewed the history regarding the Orvis School of Nursing’s conditional approval status. Patsy Ruchala, DNSc, RN, director of Orvis School of Nursing, reported on the school’s recent achievements, including a mentoring program for new faculty, curriculum improvements, and an 82.28% NCLEX-RN first-time pass rate in 2005. It was moved and seconded the Board withdraw conditional approval status and grant full approval to Orvis School of Nursing. MOTION CARRIED. M. A. Lambert and D. Begley recused themselves.

  2. Review and discussion regarding Great Basin College 2005 NCLEX pass rate: D. Cowling explained that Great Basin College’s NCLEX-RN first-time pass rate was 73.91% in 2005. Per NAC 632.630, if a nursing education program’s pass rate falls below 80%, the program must present an action plan regarding how it will address the situation. Margaret Puccinelli, PhD, RN, director of the college’s nursing programs, described factors leading to the 2005 pass rate, including a small number of graduates, admission criteria, and lack of NCLEX test preparation by students. She described subsequent actions the program has taken, including incorporating pre-testing strategies, working with employers to provide stipends to give working students time to study, and meeting individually with each student. Dr. Amy Chapin, one of the college’s nursing instructors, reported on the statistical analysis she performed to discover why the class of 2005 performed poorly on the NCLEX-RN compared to previous classes. Her findings included low math and reading comprehension scores for those who failed the NCLEX and high scores in science courses for those who passed the exam. M. Puccinelli said she used the results of the statistical analysis to revise the program’s admission criteria.

  3. Discussion of the California Board of Nursing’s court case regarding Excelsior College: F. Olmstead reviewed the California code regarding education requirements for nursing licensure, which include the words “equivalent to in-state.” California’s in-state requirements include 810 hours of supervised practice. The California State Court of Appeals ruled that Excelsior College’s nursing education program does not include 810 hours of supervised practice or its equivalent. Nevada statute does not have such language; it requires applicants to graduate from an accredited school of nursing. Excelsior College is nationally accredited. Dr. Nettleton of Excelsior College addressed the Board, describing actions the college has taken since the court decision, including working with the California State Board of Nursing to attempt to bridge the gap in clinical requirements. She added that Excelsior graduates are still eligible for licensure by endorsement in California. Dr. Nettleton responded to Board member questions. D. Burgio requested that clinical requirements for nursing education program be placed on the agenda for the next Education Advisory Committee meeting.

  4. Direction by the Board regarding approval of nursing programs not leading to initial licensure: F. Olmstead described the research and discussion by the Education Advisory Committee that led to the recommendation. He also stated that the legislative intent of the laws that govern the Board’s jurisdiction over nursing education programs was that the Board had jurisdiction only over nursing education programs that led to initial licensure. The Board agreed that its mission to protect the public was best fulfilled by regulating only those nursing education programs that lead to initial licensure.

 

F.      NURSING PRACTICE:

  1. Review, discussion and action regarding applications for the Advanced Practice Advisory Committee: It was movedand seconded the Board reappoint Amy Booth, MSN, RN, APN, to the Advanced Practice Advisory Committee. MOTION CARRIED.

  2. Review, discussion and action regarding applications for the Nursing Practice Advisory Committee: It was moved and seconded the Board appoint Mary Wherry, MS, RN, (Medicaid) and Vickie Wright, MBA, RN, CRRN, CCM, to the Nursing Practice Advisory Committee. MOTION CARRIED.

  3. Review, discussion and action regarding Validation of Reference Materials policy: D. Scott presented the background, discussion, and research done by the Nursing Practice Advisory Committee that led to the development of the new policy. It was moved and seconded the Board approve the proposed policy as written. MOTION CARRIED.

  4. Review, discussion and action regarding RN scope of practice to interpret the placement of a PICC line using a chest X-ray: D. Scott presented the background, discussion, and research done by the Nursing Practice Advisory Committee that led to the proposed practice decision revision allowing RNs to interpret PICC line placement using a chest X-ray. She stated it is accepted practice in at least 15 states and cited physician testimony regarding its safety. Board member discussed the proposed revision and recommended adding it as a new section #4 under the heading “Recommendation.” It was moved and seconded the Board approve the proposed revision as written, with the addition of adding a new section #4. MOTION CARRIED.

  5. Applications in question regarding NRS 632.307

    1. Tripp, Renata, RN applicant. Applicant was not present. The Board accepted the application for licensure and issued a license with limitations pursuant to NRS 632.307.  Accepted under the Consent Agenda.
