CALL TO ORDER

The Regular Meeting of the Nevada State Board of Nursing was called to order by the President, Patty Shutt, LPN, at 9:07 a.m. on March 31, 2004, at the Meadow Wood Courtyard, 5851 S. Virginia Street, Tahoe Room A, Reno, NV  89502

APPROVAL OF CONSENT AGENDA

It was moved and seconded the Board approve the Consent Agenda, identified as items: A.1, A.6, C.1.c, D.2.a-e, h-v, D.7.b-d, f, D.8.a-b, E.1.  M.A. Lambert recused on D.2.q.; H. Vos recused on D.2.v.  MOTION CARRIED.

 

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Board meeting, January 21-23, 2004:  Approved under the Consent Agenda.

  2. Report from National Council Mid-Year meeting: Attendees included C. Bible, J. Cortez, M. Lambert, P. Shutt, D. Scott, and D. Rennie.  Presentations included the globalization of nursing, the impending federal visa screening requirements for certain international nurses, the proposed revisions to the NCLEX-PN Test Plan, processes to enhance customer and public satisfaction, and various licensure and discipline models.  It was noted by all who attended that networking with other attendees proved extremely valuable.     

  3. Financial statements quarterly report:  Presentation by D. Scott and M. Flannigan.  A financial review of the first two quarters of the fiscal year was presented. 

  4. Review statistics and trends:  Presentation by D. Scott, D. Rennie, C. Sansom and C. Kimball.  Trends in practice questions received in both Board offices were reviewed. 

  5. Progress report on FY 03/04 Priorities:  Presentation by D. Scott, D. Rennie, R. Buck, C. Sansom and C. Kimball.  The first edition of the Board’s quarterly magazine has been distributed to all currently RN, LPN and CNA license/certificate holders.  It has been extremely well received.  Numerous changes have been made to the Board’s website to provide more information and enhance the user friendliness of the site.  In the past two months the number of staff presentations on licensure, the alternative program, Board mission and functions, and discipline has greatly increased.   

  6. Contract ratification Metavante Corporation:  Approved under the Consent Agenda. 

  7. Discussion and action regarding NAC 632.670 – Faculty: Qualifications:  It was moved and seconded the Board approve the concept and wording changes to the regulation as revised in discussion.  MOTION CARRIED.

  8. Discussion and action regarding NAC 632.675 – Faculty: Composition; requirements:  It was moved and seconded the Board approve the concept and wording changes to the regulation as presented.  MOTION CARRIED.

  9. Discussion and action regarding NAC 632.685 – Curriculum; basis for awarding credit:  It was moved and seconded the Board approve the concept and wording changes to the regulation as revised in discussion.  MOTION CARRIED. 

  10. Discussion and action regarding NAC 632.690 – Requirements for instruction; records of evaluation of curriculum:  It was moved and seconded the Board approve deletion of the regulation as presented.  MOTION CARRIED.

  11. Discussion and action regarding NAC 632.257 (2) – Recommendation from the APN Committee regarding documentation of 1,000 hours of active practice:  It was moved and seconded the Board approve the concept and wording changes to the regulation as presented.  MOTION CARRIED

  12. Report from NCSBN Foreign Graduate Subcommittee:  Presentation by D. Rennie.  The subcommittee has representatives from the following Boards of nursing:  California-RN, Georgia-RN, Kansas, Kentucky, Nevada and Ohio.  The mission of the subcommittee is to review issues and make recommendations related to licensure of international nursing graduates.  At the first meeting the subcommittee reviewed the 2002 NCSBN international nurse manual, levels of credentials evaluation, the Model Rules and Acts pertaining to international graduates, and the visa screen process.  The subcommittee will meet in April and June, 2004.  Recommendations will be submitted to the NCSBN Practice Committee.   

  13. Discussion regarding NSBN employee evaluation process:  Presentation by D. Scott. A proposal was presented to modify the evaluation process whereby the Board would continue to evaluate the executive director at the Board meeting. Managers would evaluate their respective employees under the guidance and direction of the executive director.  It was moved and seconded the Board approve the proposal as presented.  MOTION CARRIED.  

  14. Review and approval of FY 05 Budget:  Presentation by D. Scott and M. Flannigan. It was noted there are changes in the CNA allocations due to the staff time and effort studies conducted over the past year.  Travel expenses are projected to increase with the loss of the state’s Southwest Airline contract.  Anticipated revenues were discussed.  Budgetary expenses include an additional FTE, equipment upgrades, and expansion of technology to support the mission.  It was moved and seconded the Board approve the budget as presented.  MOTION CARRIED.

  15. Progress report regarding online renewal:  Presentation by D. Scott, D. Rennie and M. Flannigan.  Online renewal was implemented with the April, 2004 RN, LPN and APN renewals.  During the first two months, the number of renewals processed online was approximately 60% of eligible applicants. The system has been well received by the users.  Refinements continue to enhance the system and make it even more user friendly. 

 

B.     LICENSURE PROGRAMS: 

1.      Discussion and action regarding proposed changes to NCLEX-PN Test Plan:  Presentation by D. Rennie.  The proposed changes are based on a recent practice analysis of practical nursing completed by the National Council of State Boards of Nursing.  The Test Plan format will follow that of the recently implemented revised NCLEX-RN Test Plan.  It was moved and seconded Board comments and recommendations be provided to the National Council of State Boards of Nursing.  MOTION CARRIED. 

 

C.     CERTIFICATION PROGRAMS

  1. Certified Nursing Assistants

    1. Appointment to CNA Advisory Committee:  It was moved and seconded the Board appoint Tonya Evans-Poole, CNA and Terri Shoemaker, CNA.  MOTION CARRIED. 

    2. Approval of annual CNA Program Report for Federal Fiscal Year 2003:  Item removed from the agenda.

    3. Approval of CNA program survey at Great Basin College:  Approved under the Consent Agenda.

e.       King, Isabel, LPN04894:  It was moved and seconded the Board find the Respondent guilty of one count of NRS 632.320 (7) unprofessional conduct and NAC 632.890 (24) failing to collaborate and (25) failing to report changes.  It was moved and seconded the Board revoke Respondent’s license.  Respondent may not apply for reinstatement for a period of two (2) years, and must successfully complete an anger management course prior to application.  It was moved and seconded the Board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.  Pursuant to NRS 632.325 (1)(c), it was moved and seconded the Board charge the Respondent with the actual attorney fees and costs of the hearing which are payable within one hundred twenty (120) days from issuance of the actual costs.  MOTION CARRIED.

f.        Land, Ria, CNA000976:  Respondent was present with counsel.  It was moved and seconded the Board find Respondent guilty of one count of NRS 632.320 (2)(b) conviction related to the qualifications, function or duties of a certificate holder.  It was moved and seconded the Board reprimand the Respondent.  It was moved and seconded the Board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

g.       Newby, Michele, CNA016524:  It was moved and seconded the Board find the Respondent guilty of one count of NRS 632.320 (14) violation of a Board order.  It was moved and seconded the Board suspend Respondent’s certificate until the administrative fine of $100.00 is paid in full. It was moved and seconded the Board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to all appropriate agencies. MOTION CARRIED.

h.       Phillips, Rosa, RN43548:  It was moved and seconded the Board accept the Voluntary Surrender of License/Certificate in Lieu of Other Disciplinary Action for violation of NRS 632.320 (7) unprofessional conduct and NAC 632.890 (11) positive urine drug screen.  MOTION CARRIED.   

i.         Rockovich, Joe, CNA011977:  Respondent was present.  It was moved and seconded the Board find the Respondent guilty of one count of NRS 632.320 (2) criminal conviction. It was moved and seconded the Board revoke Respondent’s certificate.  Respondent may not apply for reinstatement for a period of one (1) year, and must submit documentation to the Board that he has been successfully discharged from criminal probation.  It was moved and seconded the Board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

j.        Ziegler, Traci, RN32420:  It was moved and seconded the Board accept the Agreement for Probation for violation of NRS 632.320 (7) unprofessional conduct and NAC 632.890 (16)(a) failing to document the administration of controlled substances.  MOTION CARRIED.

k.      Adams-Veno, Carlyn, LPN04405:  It was moved and seconded the Board find the Respondent guilty of one count of NRS 632.320 (2) convictions and one count of NRS 632.320 (5) use of controlled substance, dangerous drug or intoxicating liquor. It was moved and seconded the Board revoke the Respondent’s license. Respondent may not apply for reinstatement for a period of (2) years.  It was moved and seconded the Board order the disciplinary action become part of the Respondent's permanent record and be published and reported to all appropriate agencies.  Pursuant to NRS 632.325(1)(c), it was moved and seconded the Board charge the Respondent with the actual attorney fees and costs of the hearing, which are payable within one hundred twenty (120) days from issuance of the actual costs. MOTION CARRIED.

l.         Neder, Gail, RN29472: Respondent was present. It was moved and seconded the Board continue this matter to the May 2004 Board meeting.  MOTION CARRIED. M.A. Lambert recused herself. The Board's Executive Director Debra Scott indicated to the Board and Respondent that pursuant to Ms. Neder's Agreement for Probation, the executive director requests that respondent voluntarily surrender her license until such time that the Board can hear the facts in her case. Ms. Neder indicated she would come into the Board office to do so.

m.     Hunt, Linda, RN30965:  It was moved and seconded the Board find the Respondent guilty of one count of NRS 632.320 (7) unprofessional conduct, including the acts found in NAC 632.890 (10) positive urine drug screen.  It was moved and seconded the Board revoke the Respondent’s license. Respondent may not apply for reinstatement for a period of (2) years.  It was moved and seconded the Board order the disciplinary action become part of the Respondent's permanent record and be published and reported to all appropriate agencies.  Pursuant to NRS 632.325(1)(c), it was moved and seconded the Board charge the Respondent with the actual attorney fees and costs of the hearing, which are payable within one hundred twenty (120) days from issuance of the actual costs. MOTION CARRIED.

n.       Lockwood, Diana, RN22766: It was moved and seconded the Board accept the Voluntary Surrender of Licensure in Lieu of Other Disciplinary Action for a violation of NRS 632.320 (14) failure to comply with a order of the Board and NAC 632.890 (10) positive urine drug screen. MOTION CARRIED.

  1. Ratification of staff denials - (NRS 632.320 (1) fraudulent applications:

b.      Ahmed, Saima, CNA applicant: The Board ratified the staff denial of the application for certification based on a violation of NRS 632.320 (1) fraudulent application and ordered the denial become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.  Accepted under the Consent Agenda.

d.      Roa, Eduardo, CNA applicant: The Board ratified the staff denial of the application for certification based on a violation of NRS 632.320 (1) fraudulent application, and ordered the denial become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.  Accepted under the Consent Agenda.

e.       Warmbrodt, Sarah, RN applicant:  Applicant was present.  It was moved and seconded the Board ratify the staff denial of the application for licensure based on a violation of NRS 632.320 (1) fraudulent application and ordered the denial become part of the Respondent’s permanent record and be published and reported to all appropriate agencies. In addition, should the applicant reapply for licensure within the next 30 days, it was moved the Board accept the reapplication.  MOTION CARRIED.

It was moved and seconded the Board close the meeting to consider the character, alleged misconduct, or professional competence of the applicant. MOTION CARRIED. It was moved and seconded the Board reopen the meeting. MOTION CARRIED. It was moved and seconded the Board overturn the staff denial and accept the application for licensure.  MOTION CARRIED.

d.      Leon, Jonathan, CNA applicant:  Applicant was present. It was moved and seconded the Board overturn the staff denial, accept the application for certification and order the applicant to submit monthly statements from the Court that he is in compliance with his fine payment schedule and submit documentation the balance of the fine has been paid within a six months of the order’s execution.  MOTION CARRIED.

E.     EDUCATION 

  1. Six-month status report from Nevada State College:  Approved under the Consent Agenda. 

  2. Discussion and action regarding California BRN action related to Excelsior College:  Presentation by D. Rennie.  The California BRN, at its February 2004 meeting, concluded Excelsior College must comply with the regulatory requirement that a nursing program must have concurrent theoretical instruction and clinical experience.  In addition, the program must meet the 800 hours of clinical experience requirement.  Excelsior College is surveying nursing programs nationwide to identify the number of hours of clinical experience presented.  Excelsior College is continuing to pursue legal action against the California BRN.

  3. Discussion and action regarding Community College of Southern Nevada LPN Online Program:  Presentation by Deborah Ain, MSN, RN, Program Director.  It was moved and seconded the Board approve the proposed curriculum changes as presented.  MOTION CARRIED.

  4. Discussion and action regarding Community College of Southern Nevada RN Program curriculum revision:  Presentation by Lisa Kless-Kern, MSN, RN, CCSN RN Program Director.  It was moved and seconded the Board approve the proposed curriculum changes as presented.  MOTION CARRIED.

  5. Discussion and action regarding Nevada State College Nursing Program curriculum revision:  Presentation by Connie Carpenter, EdD, RN, Nursing Program Director.  It was moved and seconded the Board approve the proposed curriculum changes as presented.  MOTION CARRIED.

  6. Discussion and action regarding Truckee Meadows Community College Nursing Program curriculum revision:  Presentation by Mary Love, PhD, RN, Interim Nursing Program Director.  It was moved and seconded the Board approve the proposed curriculum changes as presented.  MOTON CARRIED.

F.      NURSING PRACTICE

1.      Review of proposed practice decision regarding SANE.   Presentation by D. Scott.  Testimony was received from Kim Schweickert and Bret Kandt of the Washoe County District Attorney’s Office.  It was moved and seconded the Board approve the revised practice decision as presented.  MOTION CARRIED. 

2.      Appointment to the Nursing Practice Advisory Committee:  It was moved and seconded the Board appoint Ryan Murphy, RN.  MOTION CARRIED.

3.      Review of proposed practice decision regarding the role of consultants, surveyor or nurse educator:  Presentation by D. Scott and F. Olmstead.  It was moved and seconded the Board approve the practice decision as revised in discussion.  MOTION CARRIED.
