MINUTES OF REGULAR BOARD MEETING

May 18-20, 2005

 

The Regular Meeting of the Nevada State Board of Nursing was called to order by President, Patty Shutt, LPN, at 9:00 a.m. on May 18, 2005, at the Nevada State Museum and Historical Society, 700 Twin Lakes Drive, Las Vegas, NV 89107.

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Board Meeting, March 16-18, 2005: Approved under the Consent Agenda.

  2. Review, discussion and action regarding the evaluation of the Executive Director, Debra Scott: It was moved and seconded to close the meeting to consider a person's character, alleged misconduct, professional competence, or physical or mental health..It was moved and seconded to open the meeting to act upon the evaluation of Executive Director Debra Scott. It was moved and seconded to accept the evaluation with an increase of the “Knowledge” rating from 4 to 5. MOTION CARRIED.

  3. Financial statements quarterly report: Accepted under the Consent Agenda.

  4. Review, discussion and action regarding approval of FY 05/06 Budget: D. Scott and D. Estes presented the proposed FY 05/06 budget and responded to Board member questions. It was moved and seconded to accept the budget as written. MOTION CARRIED.

  5. Public Hearing: NAC 632.155, NAC 632.167, NAC 632.170, and NAC 632.605: Board members reviewed the transcripts from the Public Workshop held via videoconference on April 26, 2005. D. Scott presented the proposed regulations and solicited public comments on each proposed regulation. There were no public comments. It was moved and seconded to approve the proposed regulations as written. MOTION CARRIED.

  6. Progress report on FY 04/05 Goals and Objectives: Presentation by D. Scott. Progress related to achievement of Board goals by staff were noted and discussed.

  7. Conference and seminar report: D. Scott discussed her participation in the recent National Council of State Boards of Nursing Executive Officer seminar.

  8. Staff report on Project Automation: D. Scott and D. Estes gave an update on technology plans and project automation, including online capability for RN/LPN and CNA initial and renewal applications.

  9. Discussion of the Board Annual Business Meeting: P. Shutt led discussion regarding potential items and agenda for Board Annual Business Meeting.

  10. Contract ratifications: The McFarlane Group: Removed from the agenda.

  11. Discussion regarding per diem for state employees:  F. Olmstead discussed NRS 281.127, which provides that no public employee may be paid more than one salary for all services rendered to the State.  Also, discussed several Attorney General Opinions regarding the use of annual or sick leave from a state job and the collection of pay from another source.

  12. Review statistics and trends: C. Sansom presented information on Board statistics and trends, including types of scope of practice calls and number of initial licenses/certificates issued.

It was moved and seconded the Board find the Respondent guilty on the basis of the contents of the Stipulation of Facts and Liability received into evidence for violation of NRS 632.320 (14) failing to comply with Board order.  It was moved and seconded the Board order the Respondent’s current probation be extended three (3) additional years, with monthly reports.  Further, the Board ordered the Respondent to cause her physician to submit a written treatment plan, and submit her own plan of action to the Board by June 15, 2005.  Respondent shall appear before the Board at the September 2005 meeting to report on her compliance with the terms and conditions of probation.  It was moved and seconded that the Board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

It was moved and seconded the Board find the Respondent guilty of violating NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (24) failing to collaborate with health care team, and (27) customary standards of practice.  It was moved and seconded the Board fine the Respondent in the amount of $100.00, reprimand the Respondent, and order that she complete Board approved courses in legal ethics, the Nurse Practice Act, and critical thinking, all non-home study to be completed within one (1) year. The Board ordered that the Respondent may not work in extended care, home health, or intermediate care for a period of one (1) year. 9.      Special Action:

a.  Approval of application for Outpatient Treatment/Aftercare Provider: It was moved and seconded the Board approve Mary J. Reed, PhD, APN, CS, BC, and Jeff Walter, LADC, NCAC 1, SAP, as Outpatient Treatment/Aftercare Providers.  MOTION CARRIED.

b.    Approval of application for Treatment Program: The application for the Center for Addiction Medicine was approved under the Consent Agenda. 

c.  Baker, Diana, RN25515:  Respondent was present.  It was moved and seconded the Board grant the request for reconsideration. It was moved and seconded the Board find the respondent guilty of NRS 632.320 (14) failing to comply with Board order.  It was moved and seconded the Board uphold the discipline previously ordered.  MOTION CARRIED.

d.   Lemich, Boja, RN14845, APN000550:  Respondent was present.  It was moved and seconded the Board lift the suspension, and reinstate the Respondent’s license and certificate following the terms and conditions of the probation as previously ordered.  MOTION CARRIED.    

 

E.     EDUCATION

1.      Review, discussion and action regarding Nevada State College six-month report: Connie Carpenter, EdD, RN, Nevada State College nursing school director, presented the college’s six-month report, stating that the nursing program was now accredited by the National Commission on Collegiate Nursing Education, and its first class of students will graduate in May.

2.      Discussion and action regarding Western Nevada Community College request for nursing program curriculum change: Judith Cordia, EdD, RN, Western Nevada Community College nursing school director and associate professor of nursing, presented a request to change the credits of two courses offered in the third semester of the program (NURS 265: Alterations in the Childbearing/Childrearing Family and NURS 270: Advanced Clinical Nursing 1). It was moved and seconded to approve the request. MOTION CARRIED.

3.      Review, discussion and action regarding American Scientific Institute application to establish a nursing program. D. Scott discussed materials and application submitted by American Scientific Institute (ASI). ASI representatives Lynne Fruchtman, Phyllis Cooper, Diana Greene and Dennis Barker, and counsel Richard Bryan described the ASI proposal and responded to questions by Board members. It was moved and seconded to continue this item until the June 17 2005 Special Board meeting to give ASI time to provide answers to outstanding questions. MOTION CARRIED.
