The Regular Meeting of the Nevada State Board of Nursing was called to order by President Helen Vos, MS, RN, at 9:03 a.m. on May 21, 2008 at Tuscany Suites, 255 E. Flamingo Road, Las Vegas, NV 89169.

CALL TO ORDER – 9:03 a.m.

 

PUBLIC COMMENT: Kathleen Shinn, RN, spoke about her daughter's death in 2006, after receiving an overdose of medication.  She stated that there are problems with safety measures in healthcare that need to be addressed so that no one ever has to experience what her daughter and her family had to endure.  She stated that her experience should be a wake-up call to the Board of Nursing.

 

      APPROVAL OF CONSENT AGENDA

It was moved and seconded to approve the Consent Agenda, identified as items A.1., C.1-5., D.2 a.-tt, D.3.a-b., D.8.a, D.8.e., and F.1.a-b.  A.4., 6., D.7.a-b, removed, and D.8.b.-e. were removed. C. McMurray recused herself from D.2.o and cc., M.A. Lambert recused herself from D.2.p and v. MOTION CARRIED.

 

 

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Board meeting, March 13-14, 2008: Approved under the Consent Agenda.

  2. Progress report on FY 07/08 goals and objectives: D. Scott reported on recent progress related to achievement of Board goals and objectives since the last reporting period.

  3. Contract Ratifications: Prometric. Approved under the Consent Agenda.

  4. Financial statements quarterly report: This item was removed from the Consent Agenda for discussion. D. Estes described the process by which fingerprint processing fees are handled between the Nevada State Board of Nursing and the Department of Public Safety. It was moved and seconded the Board accept the financial statements quarterly report. MOTION CARRIED.

  5. Conference and seminar report: Several Board members and staff members gave short summaries of the conferences they have attended in the past two months.

  6. Annual adoption of Non-Discrimination Policy: This item was continued until the next regularly scheduled Board meeting.
  7. Review, discussion, and action regarding regular Board meeting dates schedule for 2009 calendar year:  It was moved and seconded the Board approve the following 2009 Board meeting dates—January 7-9, March 18-20, May 13-15, July 15-17, September 16-18, and November 18-20,2009.  MOTION CARRIED.
  8. Review, discussion, and action regarding conference attendance schedule for 2008:  It was moved and seconded to approve the conference attendance schedule as discussed, and to allow the executive director/Board president to approve additional conferences as appropriate. MOTION CARRIED.
  9. Review statistics and trends: C. Sansom presented information on Board statistics and trends, including types of scope of practice inquiries received during the previous two months.
  10. Executive Director annual evaluation:  H. Vos, Board President, presented the executive director, D. Scott’s annual evaluation while D. Begley, Board Vice President, took minutes. It was moved and seconded the Board accept the evaluation and the proposed merit increase. MOTION CARRIED.
  11. Review, discussion, and action regarding the implementation and transition plan for online initial application: This item was removed from the agenda.
  12. Legislative update:  D. Scott and F. Olmstead gave a short legislative update describing the regulatory activities that had impacted the Board in the last two months.
  13.  Review, discussion and action regarding hearing for proposed regulations: F. Olmstead presented the proposed regulations changes.  He compared and contrasted the original wording of the proposed regulations and the Legislative counsel Bureau (LCB) wording, including the transcript from the public workshops to solicit comments from the public. Regulations identified as agenda items A.13. b. through d. and f. through k. and m. through o. were approved as written by the LCB.  The proposed regulation identified as agenda item 13.a. and e. were withdrawn, and the proposed regulation identified as agenda item 13.l was referred back to LCB with a request that the original language be reinstated. MOTION CARRIED.

  14. Review, discussion, and action regarding bill draft request: D. Scott and F. Olmstead presented the information that has been submitted in the form of a bill draft request for the NSBN. The Board members agreed with the proposed concept and wording. MOTION CARRIED.

  15. Review, discussion, and action regarding approval of FY 08/09 Budget:  D. Scott and D. Estes presented the FY 08/09 Budget for the NSBN.  The Board members expressed concern regarding the deficit nature of the budget and suggested that staff consider the deficit in awarding merit and cost of living allowances to Board staff. No changes were made to the proposed budget and it was moved and seconded the Board approve the proposed budget.  MOTION CARRIED

 

B.     LICENSURE PROGRAMS

  1. Ross, David Glen, RN applicant: Applicant was present. Review, discussion, and action regarding appeal of staff denial based on education requirements: It was moved and seconded to ratify the staff denial of licensure by endorsement. MOTION CARRIED.

  2. Nwinye, Achinike Ian, LPN applicant: Applicant was present. Review, discussion, and action regarding appeal of staff denial based on education requirements: It was moved and seconded to ratify the staff denial of licensure by endorsement. MOTION CARRIED.

C.     CERTIFICATION PROGRAMS

  1. Ratification of NSBN staff survey of the Mount Grant Hospital nursing assistant training program: Approved under the Consent Agenda.

  2. Ratification of the NSBN staff survey of the South Lyon Medical Center nursing assistant training program: Approved under the Consent Agenda.

  3. Ratification of the NSBN staff survey of the Truckee Meadows Community College     nursing assistant training program: Approved under the Consent Agenda.

In addition, should the applicant reapply for licensure within the next 30 days, and the application has no material changes, Board staff may accept the application for further processing. E.     EDUCATION

1.       Review and discussion of first quarter 2008 NCLEX scores: R. Colosimo reported that the graduation numbers are low at this time of year. Board member M.A. Lambert requested further explanation of the rolling quarter scores and stated they are confusing.

2.        Review and discussion regarding 6 month progress report for Nevada State College   Nursing Program: Dr. Connie Carpenter announced her resignation as of July 1, 2008. H.Vos expressed the NSBN appreciation for all the hard work to start a nursing college.  Dr. Carpenter reviewed the progress that has been made with pub meds and new admission requirements. Dr. Carpenter described the use of grant money in the program. D. Begley requested more information on the grant. Dr. Carpenter said Congressman John Porter had helped with grant.

3.   Review and discussion regarding 6 month progress report for Touro University Nursing Program: Dr. Robyn Nelson announced that Dr. Douglas Turner was returning to a faculty position on July 1, 2008 and that a nation wide search was being conducted for a Director.  Dean Nelson and the Assistant Director, Diane Fillmore will handle the responsibilities.  Dr. Nelson reviewed progress being made with faculty education and mentoring to improve the program. Dr. Nelson stated they have admitted 80 students and 50% are out of state. M.A. Lambert requested that Dr. Nelson communicate to Dr. Turner that the 6 month report was excellent.

4.   Review and discussion regarding 6 month progress report for University of Southern Nevada Nursing Program: Dr. Mable Smith stated that they were changing requirements especially cumulative tests being initiated because of NCLEX scores. Dr. Smith stated she appreciated the help of R. Colosimo in responding to unhappy students.

5.  Review and discussion regarding 6 month progress report for Apollo College Nursing Program: Dr. Dina Faucher and Babbette Murphy informed the NSBN that Tamra Carley had resigned as Director of the Program and that a search was on to find a Director. Currently Dr. Faucher is coming to the Las Vegas campus 2 days a week and B. Murphy who is an MSN and campus director will handle day-to-day matters. M.A. Lambert expressed concern that this was the fourth change in administration in about that many years. Dr. Faucher said this change was very good and good things are happening. Dr. Faucher stated that bullying, cheating and the nonutilization of the Sim manikin were problems that were being corrected. The first class graduated 16 students on April 7, and in September there will be NCLEX results. M.A. Lambert asked questions about the unqualified faculty member who had been teaching a short time. R. Colosimo clarified the educational status of the employee at Apollo who would be teaching other courses and would not be able to teach nursing until she completes her MSN in October, 2008.

6.   Review and discussion regarding 6 month progress report for National University Nursing Program: Dr. Lara Carver received congratulations on completing her doctoral studies from H. Vos. Dr. Carver introduced Theresa Tarrant who is her faculty member and announced they have been to the NLNAC preparation conference. They plan to start next month with 6-8 students in the first class. M.A. Lambert reinforced that small and well done was very good. 

7.    Review, discussion, and action regarding the application for candidate for provisional approval of Heritage College for a LPN Nursing Program: Campus Director Beth Berselli announced that on June 2,2008, Heritage College would officially become Kaplan College.  D. Begley had questions about whether there were more Heritage Colleges.  B. Berselli said this college was not related to Heritage Colleges in Colorado and Utah. H. Vos requested more information on whether any credits would transfer to other nursing programs. Lily Gonzales stated once they received NLN accreditation the students would be able to transfer credits. H. Vos expressed concern that the IV certification course was not part of the curriculum but rather occurring after the regular curriculum. L. Gonzales stated she would be able to offer the course to others in the community. Dr. Deanne Remer stated the IV content was integrated through the curriculum but also stood as a separate course to meet specifics of Nevada Law. The Board members also expressed concern about whether or not there was a need for an LPN program. A discussion of the Packam report ensued. S. Halley asked what the roles of LPN and RN are. L. Gonzales described differences in assessment and being responsible for the plan of care. It was moved and seconded the Board advance Heritage College to candidacy for provisional status, and if the site visit survey meets Nevada’s requirements, advance the program to full provisional status. MOTION CARRIED.

8.   Review, discussion, and action on curriculum change for the College of Southern Nevada (CSN) Refresher Program: Jan Kramer from CSN presented the newest skills list to the Board members and explained the addition of 24 hours of lab skills time to improve readiness for the clinical portion. The Board members thanked J. Kramer for the CSN efforts considering the difficulties involved in refresher courses. It was moved and seconded the Board approve the curriculum changes for the refresher course. MOTION CARRIED.

10. Review, discussion and action regarding the request by Apollo College for a NSBN letter of support for the appeal of an NLNAC accreditation decision: H Vos questioned R. Colosimo about an email she provided from Dr. Sharon Tanner at NLNAC which stated their wasn’t an appeal process. Dr. Tanner stated that ACIS could reapply at any time to be reconsidered. H Vos told Dr. Faucher that she did not think it was the Board’s role to write a letter of this type to NLNAC.  F. Olmstead added and clarified that providing such a letter was not in the role of the Board as defined in Nevada law. H. Vos clarified that the Board would want to hear the outcome of the appeal hearing as it is significant to full approval for Apollo College.  Dr. Faucher clarified that Apollo had until April of 2010 to obtain NLN accreditation. R. Colosimo validated that April 2010 was correct.
