CALL TO ORDER

The Regular Meeting of the Nevada State Board of Nursing was called to order by the President, Patricia Shutt, LPN, at 9:00 a.m. on May 7, 2003 at Nevada State Museum and Historical Society, 700 Twin Lakes Drive, Las Vegas, Nevada 89107.

APPROVAL OF CONSENT AGENDA

It was moved and seconded to approve the Consent Agenda, identified as items A.1.a-b, A.8, A.10, B.1, C.1.a, D.2.a-c, e-k, D.3.a-b, E.1.b.  MOTION CARRIED.

 

A.     BOARD GOVERNANCE AND ADMINISTRATION

1.      Approval of minutes

a.       Regular Board meeting March 12-14, 2003:  Approved under the Consent Agenda. 

b.      Special Board meeting April 18, 2003:  Approved under the Consent Agenda. 

2.      Progress report on FY priorities:  Oral presentation by D. Scott.  Board staff actions of the past two months supporting the priorities and goals established by the board were discussed.  The priorities include governance and administration, nursing practice, discipline, education, licensure, and certification  

3.      Review statistics and trends:  Oral presentation by D. Rennie and D. Scott.  NCLEX RN/PN pass rate information was presented for comparisons by calendar and fiscal year.  International nurse graduate information was presented identifying country of education, testing eligibility and NCLEX pass rates.  Comparison information was provided for a period encompassing the previous eight years. Practice questions for the previous 2 months were reviewed.     

4.      Approval of Annual Budget:  Oral presentation by D Scott and M. Flannigan. It was moved and seconded to approve the annual budget with the following change: Delete subsidy of employee insurance premium.  MOTION CARRIED.

5.      Report from National Council Mid-Year meeting:  Oral presentations by C. Bible, M.A. Lambert, D. Perkins, D. Scott and P. Shutt.  All felt the conference was extremely productive with pertinent topics, excellent speakers and an opportunity to network with other boards and staff at National Council.  M.A. Lambert discussed her recent opportunity to participate in the NCLEX board member review.  It involved test site security and the evaluation of a multitude of test questions for entry level to practice and compliance with the Nevada Nurse Practice Act.    

6.      Legislative Update:  Oral presentation by D. Scott.  AB22 has been signed by the governor.  SB93 passed the Senate and is awaiting committee hearing in the Assembly.  AB313 has been referred to committee for study between legislative sessions with recommendations to be reported at legislative session 2005.  

7.      Annual approval of authorization of executive director to act as Board agent for financial transactions, keeper of the records (for issuing of and responding to subpoenas) and authority to accept voluntary surrender of licenses/certificates, and as spokesperson for actions with other community groups or the media in other routine business functions:  It was moved and seconded the board accept the approval as written.  MOTION CARRIED.

8.      Annual adoption of Non-Discrimination Policy:  Approved under the Consent Agenda.

9.      Closed session to discuss annual employee evaluations:  It was moved to close the Board meeting to consider the character and competence of board staff.  It was moved and seconded to reopen the board meeting.  It was moved and seconded to accept the evaluations and approve the merit increases as presented by the executive director and board staff.  MOTION CARRIED.

10.  Financial statements January 1, 2003 through March 31, 2003:  Approved under the Consent Agenda.

11.  Laws and regulations:

a.       Board consideration of concept and wording:

1)           Discussion and review of NAC 632.190:  It was moved and seconded to approve the proposed concept and wording as written.  MOTION CARRIED.

12.  Schedule for Board Retreat Date:  Oral presentation by D.  Scott.  The board concluded it would adhere to the schedule as previously approved.

 

B.     LICENSURE PROGRAMS

1.      Annual adoption of NCLEX passing scores as determined by National Council as the official competency examination for licensure:  Approved under the Consent Agenda.

 

 

C.     CERTIFICATION PROGRAMS

1.      Nursing Assistant

a.       Ratification of approved CNA program survey(s):  Approved under the Consent Agenda. 

2.      Advanced practice

a.       Appointment to Advanced Practice Advisory Committee:  It was moved and seconded the board re-appoint Martha Drohobyczer, MS, RN, APN, and direct staff to continue to seek an applicant with a different specialty to fill the second vacancy.   MOTION CARRIED.

i.         Edgar, Diane, RN18546: Applicant was present.  It was moved and seconded the board accept the renewal application for Registered Nurse and issue a license with limitations pursuant to NRS 632.307.  It shall be the responsibility of the applicant to use her nursing judgment to practice safely in accordance with her limitations.  Unsafe practice is considered unprofessional conduct and is subject to Nevada Revised Statutes (NRS) Chapter 632. j.        Febre, Jr., Jose, RN33269: Applicant was present.  It was moved and seconded the board continue the renewal application for Registered Nurse. Applicant was directed to complete a sexual offender evaluation.  MOTION CARRIED.

q.      Jordan, Sheila, CNA013488: It was moved and seconded the board find the Respondent guilty of one (1) count of NRS 632.320 (1) fraudulent application.  It was moved and seconded the Respondent be reprimanded and the Respondent’s certificate be suspended until her continuing education has been successfully completed. It was moved and seconded the board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.  It was moved and seconded, pursuant to NRS 632.325 (1) (c) the board charge the respondent with the actual costs of this hearing including the costs incurred which are related to any assistance received from the Office of the Attorney General and payable within one hundred twenty (120) days from issuance of the actual costs.  MOTIONS CARRIED.

r.        Kendrix, Whatana, CNA006496: It was moved and seconded the board find the Respondent guilty of one (1) count of NRS 632.320 (7) unprofessional conduct including the act found at NAC 632.890 (35) failing to comply with condition, limitation or restriction. It was moved and seconded the Respondent’s certificate be suspended until the previously ordered continuing education is successfully completed including public reprimand. cc.   Turner, James, CNA001049: It was moved and seconded that the Board find the Respondent guilty of two (2) counts of NRS 632.320 (7) unprofessional conduct including the acts found at NAC 632.890 (32) actual or implied threats and (21) obtaining, possessing, furnishing prescription drugs. It was moved and seconded the Respondent’s certificate be revoked and order its surrender.  Respondent may not apply for reinstatement for a period of two (2) years.  In applying for reinstatement the board may consider the following criteria:  Respondent must complete a psychiatric evaluation by a Board approved provider.
