The Regular Meeting of the Nevada State Board of Nursing was called to order by President Helen Vos, MS, RN, at 9:03 a.m. on May 9, 2007, at the Clarion Hotel and Suites, 325 East Flamingo Road, Las Vegas, NV 89109.

CALL TO ORDER – 9:03 a.m.

 

PUBLIC COMMENT: Patricia Thorn, RN, director of nursing, Nevada State Veterans Home, described the purpose of a letter she recently sent to the Board requesting the Board consider reducing the number of employment hours required for CNA renewal. She said that the Veterans Home has a need for drivers, diet aides, and other ancillary personnel to be CNAs, as well. She added the requirement for CNAs to work 400 hours in the scope of a CNA limits the Veterans Home’s ability to be flexible enough to meet the needs of its patients within its resources. Martha Drohobyczer, RN, CNM, spoke in support of adding to the regulatory definition of “nurse midwife” the words “primary health needs of women.” She explained that the American College of Nurse Midwives has that wording in its definition, and it is important in today’s environment, where a certified nurse midwife may be the only health care practitioner many women see. It would allow certified nurse midwives to perform full examinations, then refer patients to other practitioners as needed. Terri Shoemaker, CNA, spoke in support of reducing the CNA employment hour renewal requirement from 400 hours to 40 hours. She stated that competency can be assured in many different ways in addition to working, including adapting to different settings and improving knowledge and skills through further education and training.

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Regular Board meeting, March 14-15, 2007: Approved under the Consent Agenda.

  2. Progress report on FY06/07 Goals and Objectives: Presentation by D. Scott. Progress related to achievement of Board goals was noted and discussed.

  3. Contract ratifications: No business.

  4. Financial statements quarterly report: Approved under the Consent Agenda.

  5. Conference and seminar report: H. Vos, D. Scott, and D. Begley reported on their attendance at the NCSBN Mid Year Meeting, including participation in a leadership seminar by H. Vos and D. Scott, and D. Scott’s attendance at the Nurse Licensure Compact Administrators group, where she learned that only 11 out of the 23 member states have instituted criminal background checks. D. Begley discussed the presentation of proposed bylaws, an APN Committee report regarding a potential national test, and her attendance as a member of the resolutions committee. D. Scott discussed the report given by the Continued Competency Committee, of which she is a member, which is recommending a competency assessment for nurses, which would be piloted by volunteer states. H. Vos reported on her attendance at the presidents’ breakout groups.

  6. Review of statistics and trends: C. Sansom presented information on Board statistics and trends, including types of scope of practice inquiries received during the previous two months.

  7. Review, discussion and action regarding approval of FY 07/08 Budget: D. Scott and D. Estes presented the proposed budget and responded to Board member questions. It was moved and seconded to approve the FY 07/08 Budget as written. MOTION CARRIED.

  8. Legislative update: D. Scott reported on the status of various bills that may impact the Board and responded to Board member questions.

  9.  Executive Director annual evaluation:  Board members, led by President H. Vos, presented the evaluation of Executive Director Debra Scott. It was moved and seconded the Board approve the evaluation and the recommendation. MOTION CARRIED. 

  10.  Review, discussion and action regarding concept and wording for proposed regulation revision for NAC 632.0605: “Nurse midwife” defined: D. Scott explained that the APN Advisory Committee inadvertently did not include language regarding the primary health needs of a woman and this revision was developed to correct that oversight. H. Vos said the wording change recognizes the fact that women seek primary care from OB/GYN providers. M. Drohobyczer, APN, added that primary care is one of the core education components for certified nurse midwives. It was moved and seconded to approve the proposed concept and wording as written. MOTION CARRIED.

  11.  Review, discussion and action regarding concept and wording for proposed regulation revision for NAC 632.170: Qualifications for license or certificate without examination: F. Olmstead said that the intent of the Board’s policy adopted at its March meeting regarding endorsing applicants was in conflict with the current regulation. D. Scott said that because the Board’s intent was to allow nurses who are otherwise qualified to endorse into Nevada, the proposed regulation revisions would remove an unnecessary regulatory barrier. It was moved and seconded to approve the proposed concept and wording as written. MOTION CARRIED.

  12.  Review, discussion and action regarding concept and wording for proposed regulation revision for NAC 632.685: Curriculum; awarding of credits: R. Colosimo provided the background and rationale for proposed wording change. Board members requested wording that would make the language mandatory, rather than permissive. It was moved and seconded to accept the proposed concept and wording as revised. MOTION CARRIED.

  13.  Review, discussion and action regarding concept and wording for proposed regulation revision for NAC 632.193 Renewal of certificate: C. Sansom presented the CNA Advisory Committee recommendation to revise the regulation to state CNAs must have eight hours of employment for compensation under the direction of a licensed nurse for renewal of a certificate during the previous twenty-four months. She informed the Board of the federal requirements stated in OBRA 1989, that a CNA must have worked during the previous twenty-four months to renew a certificate. D. Perkins stated that the 400-hour requirement was created by the Board in 1999 to support employers who were having CNA retention issues because CNAs only needed to work a few hours to meet renewal requirements. D. Perkins stated she thought 400 hours was too many, but eight hours was too few and recommended 40 hours every two years. T. Shoemaker, CNA, CNA Advisory Committee member, was present and stated she supported a reduction in the employment hour requirement. A letter from L. Hoffler, RN, CNA Advisory Committee member, supporting a reduction in the requirement was submitted on the record. It was moved and seconded the Board accept the proposed regulation revision of NAC 632.193 with the following change: 40 hours of employment as a nursing assistant. MOTION CARRIED.

  14. Review, discussion and action regarding concept and wording for proposed practice decision to provide a definition of clinical experience: R. Colosimo stated that the proposed practice decision was discussed and developed with the members of the Board’s Education Advisory Committee and responded to Board member questions. H. Vos said it appeared to be written so that it allowed for innovative programs while still providing sufficient clinical practice. It was moved and seconded to accept the proposed practice decision as written. MOTION CARRIED.

  15. Discussion regarding Annual Board Meeting Agenda: D. Scott offered suggestions for topics and requested Board member suggestions. M.A. Lambert requested the education consultant lead a discussion regarding approval of new education programs.

 

B.     LICENSURE PROGRAMS

  1. Caturay, Morfina, RN applicant: Appeal of staff denial of licensure by endorsement: It was moved and seconded to ratify the staff denial of licensure by endorsement. MOTION CARRIED.

 

C.     CERTIFICATION PROGRAMS

  1. Review, discussion and action regarding survey of Nevada Care Nursing Institute’s program change to relocate CNA training site: R. Colosimo stated that the survey results showed the Nevada Care Nursing Institute’s CNA training program was not in compliance with Nevada laws and regulations, adding that the requirement for record retention by an academic administrator had been met since the survey was done. Nevada Care Nursing Institute representatives Monica Abarro, Jay Marcelo, and Ron Gonzalez introduced themselves and responded to Board member questions regarding the deficiencies noted in the survey report. It was moved and seconded to withdraw approval of the program and recommend the program follow the recommendations of the Board’s education consultant. MOTION CARRIED.

  2. Ratification of NSBN Staff survey of the Nursing Assistant Training Program—Burk Academic Preparatory Center. Approved under the Consent Agenda.

  3. White, Violet, CNA001895: Appeal of renewal requirements for a lapsed certified nursing assistant certificate: It was moved and seconded the Board uphold the lapsed status of White’s certificate. MOTION CARRIED.

E.     EDUCATION

  1. Review, discussion and action regarding National University’s application to establish a nursing education program: Nancy Saks, a National University representative, described the history of the National University system, including the formation of its nursing program, which began in 1996 with an RN-BSN program and the later establishment of a prelicensure program in California. She described the components, format, and curriculum of the proposed Nevada nursing program. H. Vos asked if the items noted as lacking in an April 2007 report by the Board’s education consultant had been addressed. N. Saks replied that the program was prepared to supply the information at the time of the site visit. D. Scott clarified that the lacking items were required prior to the site visit and that this requirement was clearly stated in the application packet and via verbal discussions between Board staff and National University representatives, including N. Saks. F. Olmstead discussed the need for all programs to meet Nevada laws and regulations. It was moved and seconded to deny National University’s application to establish a nursing education program. MOTION CARRIED.

  2. Review, discussion and action regarding Central College’s application to establish a nursing education program. This item was removed from the agenda.

  3. Review, discussion and action regarding the provisional approval status of Nevada State College: Nevada State College (NSC) representatives Connie Carpenter, EdD, RN, dean; Shirlee Snyder, associate dean; and Fred Maryanski, president; reviewed the history, recent progress, and statistical information regarding the NSC nursing program. C. Carpenter stated that since its inception, the program has admitted 11 classes at an extremely accelerated rate, and with no permanent facilities. She reviewed the information provided in NSC’s 6-month report, including program strengths and weaknesses, and discussed the NCLEX first-time pass rates and steps the college has taken to raise the rates to the required 80 percent annual level. She said those steps include the use of ATI testing and required remediation of students who do not pass the ATI. S. Snyder described the steps faculty members have taken, including curriculum changes which began in January 2007, the requirement for faculty to take the NCSBN NCLEX writing course, and increased admission standards (effective in the Fall 2007). C. Carpenter, S. Snyder, and F. Maryanski responded to Board member questions and concerns. M.A. Lambert said she would like to see the program stop growing to give it time to stabilize, succeed, and meet the Board requirements for full approval. F. Maryanski said NSC is committed to supporting the nursing program and would like to admit the students it currently turns away, but appreciates the need to stabilize, and has no plans to grow its student enrollment in the near future. It was moved and seconded to begin the provisional approval extension for the NSC nursing program on July 1, 2007. MOTION CARRIED.

  4. Discussion regarding 6-month progress report for Touro University School of Nursing: Rhoberta Jones Haley, PhD, RN, FNP, director of Touro University Nevada School of Nursing, reported the school just received CCNE accreditation for both its BSN and MSN programs, and that the current enrollment is 52 students. She reviewed the school’s progress since its last report and responded to Board member questions.

  5. Discussion regarding 6-month progress report for University of Southern Nevada School of Nursing: Mable Smith, PhD, JD, RN, dean, said that USN will be graduating its first class of students in October 2007, with 26 graduates. She described USN’s accelerated program and ongoing evaluations conducted by USN, and responded to Board member questions.

  6. Discussion regarding 6-month progress report for Apollo College Department of Nursing: Apollo College Department of Nursing representatives Dina Faucher, Sue Clarren, and Tamra Carley introduced themselves. S. Clarren stated that the program just completed its first semester, with all 16 students passing their classes. She added that the program admitted 16 more students and responded to Board member questions.

  7. Ratification of curriculum revision for Idaho Alliance of Leaders in Nursing refresher course:  Approved under the Consent Agenda.

  8. Review, discussion and action regarding Western Nevada Community College’s proposed curriculum changes: Judith Cordia, EdD, RN, WNCC director of nursing and allied health, described the changes WNCC has proposed, which were heard and recommended for Board approval by the Board’s Education Advisory Committee. They include provisions to require students to take introductory courses in both sociology and psychology, requiring students out of education for two or more years to take the National League of Nursing examination and demonstrate clinical knowledge, and adding an intravenous therapy course for LPNs to come into compliance with what is currently allowed in regulation. It was moved and seconded to approve Western Nevada Community College’s proposed curriculum changes. MOTION CARRIED.

  9. Review, discussion and action regarding applications for the Education Advisory Committee: It was moved and seconded to appoint Steve Arthur, student nurse, and Dianne Sullivan, BSN, RN, to the Education Advisory Committee. MOTION CARRIED.

 

F.      NURSING PRACTICE:

  1. Review, discussion and action regarding application for the Nursing Practice Advisory Committee: It was moved and seconded to appoint Diane Smith, RN, to the Nursing Practice Advisory Committee. MOTION CARRIED.
