The Regular Meeting of the Nevada State Board of Nursing was called to order by President Helen Vos, MS, RN, at 9:05 a.m. on November 7, 2007, at Tamarack Junction, 13101 S. Virginia St., Reno, NV  89521.

      APPROVAL OF CONSENT AGENDA

It was moved and seconded to approve the Consent Agenda, identified as items A.1.-2., D.2.a.-v., D.3.a., c.-d., D.8.e., and F.1.a.-b. H. Vos recused herself on D.2.r. MOTION CARRIED.

 

 

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Board meeting, September 12-14, 2007: Approved under the Consent Agenda.

  2. Contract ratifications: Kohn Colodny LLP. Approved under the Consent Agenda.

  3. Review, discussion and action regarding conference attendance schedule for next year: It was moved and seconded to approve the conference attendance schedule as discussed, and to allow the executive director/Board president to approve additional conferences as appropriate. MOTION CARRIED.

  4. Financial statements (quarterly report): D. Scott and D. Estes reviewed the financial statements for the quarter July 2007 through September 2007, and responded to Board member questions. D. Scott noted that although the Board is financially stable, the income has decreased in the RN and LPN endorsements and examination fee category compared to the same quarter last year. D. Estes added that revenues are still exceeding expenses overall. D. Scott affirmed that the Board is always very cognizant that the funds expended need to fit the Board’s mission.

  5. Review of statistics and trends: C. Sansom presented information on Board statistics and trends, including types of scope of practice inquiries received during the previous two months.

  6. Progress report on FY07-08 Goals and Objectives: D. Scott reported on recent progress related to achievement of Board goals since the last reporting period.

  7. Conference and seminar report: F. Olmstead reported on his attendance at the Federation of Associations of Regulatory Boards and his presentation regarding violation of Board orders and Board immunity provisions. D. Scott and C. Kimball reported on their attendance at the Citizen Advocacy Center meeting, including sessions on communication and collaboration with other agencies, continued competency, scope of practice expansions, the discipline process, and external review of regulatory boards. H. Vos, D. Scott, and M.A. Lambert reported on their attendance at the Nevada Organization of Nurse Leaders’ annual meeting, including presentations by the Veterans Administration and the magnet hospital process. D. Scott reported on her attendance at the Nevada Hospital Association’s annual meeting, including the opportunity to renew relationships with key stakeholders.

  8. Review, discussion, and action regarding NSBN annual audit: D. Estes described the statutory requirement for a biannual audit, adding the Board has consistently chosen to have an annual audit. Beth Kohn of Kohn Colodny LLP presented the audit results, described the process, and summarized the report’s findings as a “clean audit” consistent with prior years’ audits. She also commended Board staff, including D. Estes, on the strong internal controls in place. Kohn responded to Board member questions, including inquiries about insuring and collaterizing assets. It was moved and seconded to accept the NSBN annual audit. MOTION CARRIED.

 

B.     LICENSURE PROGRAMS

C.     CERTIFICATION PROGRAMS

  1. Review and discussion regarding annual report for CNA program: C. Sansom presented the annual report required under the terms of the Board’s contract with the Nevada State Health Division’s Bureau of Licensure and Certification to regulate CNAs in Nevada, which included statistics regarding certification and disciplinary actions resulting in bureau findings for the previous federal fiscal year.

 

D.    DISCIPLINE PROGRAMS

a.   Arzadon, Aldrin, CNA applicant: Applicant was present with counsel. It was moved and seconded to grant a continuance of this matter to the next Board meeting in Reno currently scheduled for March 12, 2008. MOTION CARRIED.

It was moved and seconded the Board accept the renewal application for licensure, and order that she take and successfully complete a Board approved Nevada Nurse Practice Act course and Professional Boundaries course within one year. MOTION CARRIED.

c.   Carroll, Joann, CNA012985: Applicant was present. It was moved and seconded the Board accept the renewal application for certification. MOTION CARRIED.

d.   Curtis, Christian, CNA applicant: Applicant was present. It was moved and seconded the Board deny the application for certification for violation of NRS 632.320 (2) criminal conviction, and (7) unprofessional conduct, and NAC 632.890 (27) customary standards of practice, and order the denial become part of the applicant’s permanent record and be published and reported to all appropriate agencies. MOTION CARRIED.

e.   Campbell, Tricia, CNA applicant: Applicant was present. It was moved and seconded the Board accept the application for certification. MOTION CARRIED.

f.   Gray Creaghe, Barbara, RN applicant: Applicant was not present. It was moved and seconded the Board accept the application for licensure and the Agreement for Monitoring for violation of NRS 632.320 (5) controlled substances and/or alcohol. MOTION CARRIED.

g.   Pierce, Joshua, CNA applicant: Applicant was present. It was moved and seconded the Board accept the application for certification and the Agreement for Probation for violation of NRS 632.320 (2) criminal convictions, and (5) controlled substances and/or alcohol. MOTION CARRIED.

h.   Young, Marie, LPN applicant: Applicant was present. It was moved and seconded the Board accept the application for licensure. MOTION CARRIED.

i.    Kelly, Stephen, RN applicant: Applicant was not present. It was moved and seconded the Board deny the application for licensure for violation of NRS 632.320 (5) controlled substances and/or alcohol, and (12) action in another state, and order the denial become part of the applicant’s permanent record and be published and reported to all appropriate agencies. MOTION CARRIED.

j.    Angelastro, Richard, RN applicant: Applicant was present. It was moved and seconded the Board accept the application for licensure, and issue an Order of Probation, for four years with all standard chemical dependency stipulations for violation of NRS 632.320 (2) criminal conviction, (5) controlled substances and/or alcohol, and (12) action in another state, and that the probation become part of the applicant’s permanent record and be published and reported to all appropriate agencies. was moved and seconded the Board find the allegations of the complaint to be true, and find the Respondent guilty of violating NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (35) failing to comply with Board order.  It was moved and seconded that the Board revoke the respondent’s certificate. Respondent may not apply for reinstatement for a period of two (2) years.  It was moved and seconded the Board order the disciplinary action become part of the respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

c.   Champagne, Keri, LPN11078:  Respondent was present.  It was moved and seconded the Board accept the Stipulation of Facts and Liability and find the respondent guilty of violating NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (22) patient abandonment, and (33) abuse/neglect of a patient.  It was moved and seconded the Board issue an Order of Probation for two years, and that she take and successfully complete Board approved courses on the Nevada Nurse Practice, stress management, and supervisory skills for nurses within one year. It was moved and seconded the Board order the disciplinary action become part of the respondent’s permanent record and be published and reported to all appropriate agencies. MOTION CARRIED.

d.  Clark, Deana, RN40927:  Respondent was not present.  Pursuant to NAC 632.923, it was moved and seconded the Board find the allegations of the complaint to be true, and find the Respondent guilty of violating NRS 632.320 (7) unprofessional conduct, and NAC 632.415 failing to provide continuing education to the Board.  It was moved and seconded that the respondent be reprimanded, be fined in the amount of $200.00, and must take and successfully complete a Board approved 30 CE legal ethics in nursing course, and the Nevada Nurse Practice Act course within 30 days or the license is automatically revoked without further proceedings. It was moved and seconded the Board order the disciplinary action become part of the respondent’s permanent record and be published and reported to all appropriate agencies MOTION CARRIED.

e.   Casazza, Susan, RN17372: Respondent was present.  It was moved and seconded the

Board accept the Stipulation of Facts and Liability and find the Respondent guilty of violating NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (35) failing to comply with Board order.  It was moved and seconded the Respondent be publicly reprimanded. It was moved and seconded the Board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.   MOTION CARRIED.

It was moved and seconded the Board order the disciplinary action become part of the respondent’s permanent record and be published and reported to all appropriate agencies MOTION CARRIED.

      h.   Hail, Wanda, CNA017829: Respondent was not present.  It was moved and seconded that the Board accept the Temporary Voluntary Surrender of Certificate for violating NRS 632.320 (5) controlled substances and/or alcohol, and (7) unprofessional conduct, and NAC 632.890 (9) impaired practice. Pursuant to NAC 632.923 it was moved and seconded the Board find the allegations of the complaint to be true, and find the Respondent guilty of violating NRS 632.320 (14) failing to comply with Board order and, NAC 632.890 (35) failing to comply. It was moved and seconded that the Board revoke the respondent’s certificate. Respondent may not apply for reinstatement for a period of two (2) years.  It was moved and seconded the Board order the disciplinary action become part of the respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

i.    Hall, Kristine, CNA012091:  Respondent was not present.  It was moved and seconded the Board accept the Agreement for Monitoring for violation of NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (27) customary standards.  MOTION CARRIED.

      j.   Hernandez, Ali, LPN13153:  Respondent was not present.  Pursuant to NAC 632.923 it was moved and seconded the Board find the allegations of the complaint to be true, and find the Respondent guilty of violating NRS 632.320  (14) failing to comply with Board order.  It was moved and seconded the Board suspend the respondent’s license until the administrative fine previously ordered by the Board is paid in full. It was moved and seconded the Board order the disciplinary action become part of the respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

Pursuant to NAC 632.923 it was moved and seconded the Board find the allegations of the complaint to be true, and find the Respondent guilty of violating NRS 632.320  (14) failing to comply with Board order.  It was moved and seconded the Board suspend the respondent’s license until the administrative fine previously ordered by the Board is paid in full. It was moved and seconded the Board order the disciplinary action become part of the respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

      m.  Seibert, Beth-Ann, RN21401, APN000639:  Respondent was present with counsel.  It was moved and seconded the Board find the respondent guilty of violating NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (36) practicing without an active license/certificate.  It was moved and seconded the Board fine the respondent in the amount of $100.00, and order that she take and successfully complete the Nevada Nurse Practice Act course within 6 months. It was moved and seconded the Board order the disciplinary action become part of the respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

n.   Smart, Gene, RN42511: Respondent was represented by counsel.  It was moved and seconded the Board grant a continuance of this matter to the next Board meeting in Reno, currently scheduled for March 2008, and accept the Agreement for Monitoring pending formal hearing or other action by the Board.  MOTION CARRIED.

      o.   Smith, Deone, RN06944:  Respondent was not present. Pursuant to NAC 632.923 it was moved and seconded the Board find the allegations of the complaint to be true, and find the Respondent guilty of violating NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (33) abuse/neglect of a patient.  It was moved and seconded the Board suspend the respondent’s license for a minimum of one year, and until the respondent takes and successfully completes Board approved courses on how to handle difficult patients, the Nevada Nurse Practice Act, legal ethics in nursing, and ten sessions of anger management. It was moved and seconded the Board order the disciplinary action become part of the respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED. D. Begley, and M. A. Lambert recused themselves.

      p.   Velasquez, Gloria, LPN12804:  Respondent was present.  It was moved and seconded the Board accept the Agreement for Probation for violation of NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (27) customary standards of practice.  MOTION CARRIED. 

      q.   Williams, Louise, CNA015816:  Respondent was not present. Pursuant to NAC 632.923 it was moved and seconded the Board find the allegations of the complaint to be true, and find the Respondent guilty of violating NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (11) positive drug screen as condition of employment.  It was moved and seconded the Board revoke the respondent’s certificate.  Respondent may not apply for reinstatement for two (2) years. It was moved and seconded the Board order the disciplinary action become part of the respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

 

6.      Board-directed investigations:

a.       Baldwin, Deborah, LPN02180:  It was moved and seconded the Board direct staff to investigate. MOTION CARRIED.  

 

7.      Ratification of staff denials – NRS 632.320 (1) fraudulent application:

a.   Warren, Mary Jo, RN applicant: Applicant appealed the staff denial but was not  present. It was moved and seconded the Board ratify the staff denial of the application for licensure for violation of NRS 632.320 (1) fraudulent application, and (12) action in another state and order the denial become part of the applicant’s permanent record and be published and reported to all appropriate agencies. MOTION CARRIED.

 

8.      Ratification of staff denials – NRS 632.320 (2) convictions

a.   Dawson, Patricia, CNA applicant: Applicant was present to appeal the staff denial. It was moved and seconded the Board overturn the staff denial and accept the application for certification. MOTION CARRIED.

e.   Review, discussion and action regarding application for treatment program provider: It was moved and seconded the Board approve Solutions Recovery, Inc. as a treatment program provider.  MOTION CARRIED.

 

E.     EDUCATION

1.      Review, discussion and action regarding addendum to National University’s application to establish a nursing education program in Nevada: R. Colosimo reported that National University, in an addendum to its previous application, had thoroughly addressed the Board’s request for further information regarding clinical placements and a development plan for the director. National University representatives Lara Carver, Mary Kracun, and Tom Green responded to Board member questions. It was moved and seconded to advance National University’s application to establish a nursing education program in Nevada to candidacy for provisional status, and if the site visit survey meets Nevada’s requirements, advance the program to full provisional status. MOTION CARRIED.

2.       Review and discussion regarding the 6-month progress report for Touro University: R. Colosimo explained the requirement for all provisionally approved nursing education programs to submit a six-month progress report. Touro University representatives Douglas Turner and Robyn Nelson responded to Board member questions about Touro’s six-month report, including inquiries about the accreditation process Touro is currently undergoing with WASC, faculty-student ratios, and NCLEX results.

3.      Review and discussion regarding the 6-month progress report for Apollo College: Apollo College representatives Susan Keogh, Tamra Carley, and Dina Foucher responded to Board member questions about Apollo’s six-month report, including inquiries regarding faculty qualifications and the graduation date of its first class.

4.      Review and discussion regarding the 6-month progress report and consultant report for Nevada State College: R. Colosimo explained that the Board required a consultant report in addition to the six-month report due to Nevada State College’s NCLEX-RN first-time pass rate, which has not yet met the 80 percent rate required for full approval. She gave Board members an overview of the information and recommendations contained in both reports. Nevada State College Dean of Nursing, Connie Carpenter responded to Board member questions, including inquiries regarding NCLEX pass rate reporting periods, preceptors, and faculty development. She added that the consultant report was very valuable and that the school is already working on implementing some of its recommendations. Acknowledging the fact that C. Carpenter had just received the consultant report, the Board requested that the college bring its plan to implement the essential recommendations to the Board’s May 2008 meeting.

5.      Review and discussion regarding third quarter NCLEX results: R. Colosimo presented the third-quarter NCLEX-RN first-time pass rates and responded to Board member questions.

6.      Review and discussion regarding 6-month report for University of Southern Nevada: R. Colosimo reviewed the report and explained that University of Southern Nevada representatives were not available due to a visit by its national accreditation agency.

7.   This item was removed from the agenda.
