The Regular Meeting of the Nevada State Board of Nursing was called to order by the President, Patricia Shutt, LPN, at 9:20 a.m. on November 19, 2003, at 5851 S. Virginia Street,

OPEN FORUM:  Nancy Bridges, Nurse Executive, Nevada Hospital Association, addressed the Board to introduce herself and her new role as nurse executive.   F. Olmstead, Board Counsel, discussed the “rules of evidence” as they apply to administrative proceedings.   The topic was discussed in-depth with the opportunity for Board members to ask specific questions.

 

 

APPROVAL OF CONSENT AGENDA

 It was moved and seconded to approve the Consent Agenda, identified as items: A.1., 2., 8.,  C.1.c, , D.2.a-q, D.3.a, D.7.a-d, D.8.b-h.  M. Lambert recused on D.2.p. and D.2.q.  H. Vos recused on D.2.i.  MOTION CARRIED.

 

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Board meeting, September 24-26, 2003:  Approved under the Consent Agenda.

  2. Approval of minutes of Special Board meeting, October 30, 2003:  Approved under the Consent Agenda

  3. Election of officers:  It was moved and seconded to elect P. Shutt as President.  It was moved and seconded to elect M.A. Lambert as Vice President.  It was moved and seconded to elect H. Vos as Secretary.  MOTION CARRIED.

  4. Revision to operating reserve contingency fund:  Oral presentation by D. Scott and M. Flannigan.  The economic environment and decreased funding from the CNA program lead to a recommendation to increase the operating reserve contingency fund to one year’s operating funds from the undesignated fund balance.  Additionally, designations from the undesignated fund balance should be used to fund the categories of risk management, disaster recovery and planning, leasehold improvements, and technology upgrades.   It was moved and seconded to extend the operating contingency fund to one (1) year and to designate from the undesignated fund balance the sums of $50,000 for Risk Management, $100,000 for Disaster Recovery and Planning, $75,000 for Leasehold Improvements, and $150,000 for Technology Upgrades.  MOTION CARRIED.    

  5. Review of statistics and trends:  Oral presentation by D. Scott, D. Rennie and C. Kimball.  The discussion included a review of practice trends based on scope of practice questions received by Board staff, licensure statistics, international graduate licensure statistics for FY 2002-03, and NCLEX pass rates by calendar year and fiscal year.  The Board directed staff to obtain additional information related to NCLEX, particularly Nevada nursing students who test for other boards of nursing.

  6. Progress report on FY 03/04 Priorities:  Oral presentation by D. Scott, D. Rennie, and C. Kimball.  Progress reported included the increase in all CNA-related fees, educational presentations by Board staff, Board committee actions, and information related to the requirement for bioterrorism continuing education.

  7. Discussion and direction regarding Advisory Committee to Subcommittee formed pursuant to Assembly Bill 313:  Oral presentation by D. Scott.  Passed in the 71st legislative session, Assembly Bill 313 directed the Legislative Committee on Health Care to appoint a subcommittee to conduct an interim study on the staffing system for the delivery of health care.  The Subcommittee was directed to appoint an advisory committee, of which D. Scott is a member.  D. Scott gave an overview of the meetings to date and requested the Board review the issues outlined in AB 313 and articulate its position related to these issues. 

  8. Contract ratification:  No business.

  9. Conference attendance schedule for 2004:  It was moved and seconded the Board approve the conference attendees as discussed.  MOTION CARRIED. 

  10. Review quarterly financial statements:  Oral presentation by D. Scott and M. Flannigan.  The first quarter fiscal statements of FY 03-04 were discussed.  It was noted that budget development included a projection of CNA fee increase to begin in July 2003, which will not commence until December 2003.  Overall, revenues and expenses are within predictions.

 

B.     LICENSURE PROGRAMS:  No business.

 

C.     CERTIFICATION PROGRAMS

  1. Nursing Assistant

a.       Appointment(s) to CNA Advisory Committee:  It was moved and seconded the Board appoint Barbara Fraser, MS, RN, and Vivencio Navarro, Jr, MSN, RN to the committee to represent acute care and long-term care, respectively.  MOTION CARRIED.

b.      Ratification of approved nursing assistant program surveys:  It was moved and seconded the Board approve the surveys of Highland Manor of Mesquite and Grover C. Dils Medical Center.  MOTION CARRIED.

c.       Approval of annual report for CNA program:  Tabled until January 2004 meeting.

  1. Advanced Practice

a.       Appointment(s) to Advanced Practice Advisory Committee:  It was moved and seconded the Board appoint Phyllis Suiter, RN, APN, to the committee.  MOTION CARRIED.

l.         Valena, Lowella, CNA015702:  It was moved and seconded the Board find the Respondent guilty of one count of NRS 632.320 (7) unprofessional conduct, including the acts found at NAC 632.890 (27) customary standards, (28) causing a patient harm and (35) failing to comply with a condition, limitation or restriction.  It was moved and seconded the Board revoke Respondent’s certificate.  Respondent may not apply for reinstatement for a period of two (2) years.  It was moved and seconded the Board order the disciplinary action become part of the Respondent's permanent record and be published and reported to all appropriate agencies. Pursuant to NRS 632.325(1)(c), it was moved and seconded the Board charge the Respondent with the actual attorney fees and costs of this hearing, which are payable within one hundred twenty (120) days from issuance of the actual costs. MOTION CARRIED

m.     Ziegler, Traci, RN32420:  Respondent’s counsel was present.  It was moved and seconded to grant a continuance of the hearing to the next regularly scheduled Board meeting in Reno.  It was moved and seconded the Respondent submit random urine/drug screens one time per month until her case is heard.  A positive urine/drug screen shall result in a summary suspension of Respondent’s license pending hearing.  MOTION CARRIED.

i.         Mora, Felix, CNA applicant: Applicant was present to appeal the staff denial. It was moved and seconded the Board overturn the staff denial and accept the application for certification.  MOTION CARRIED.

 

9.      Special Action

a.       Approval of application for Nurse Support Group Providers: It was moved and seconded the Board approve Thomas Lavin, MFT, LADC, as a Nurse Support Group Provider for the Board’s Alternative Program for Chemically Dependent Nurses.  MOTION CARRIED.

b.      Approval of application for Treatment Provider : No Business.

c.       Appointment to the Disability Advisory Committee: It was moved and seconded the Board appoint Deborah Inskip, RN, and Deborah E. Martz, RN, to the Disability Advisory Committee.  MOTION CARRIED.

d.      Flowers, Rachelle, Appeal of Citation:  Respondent was present.  It was moved and seconded the Board overturn the Citation.  MOTION CARRIED.

e.       Approval of increase of CNA monitoring fees. It was moved and seconded the Board increase the monthly monitoring fee for Certified Nursing Assistants on probation from $10.00 to $25.00 per month starting January 1, 2004.  MOTION CARRIED.

 

E.     EDUCATION

  1. Appointment to Education Advisory Committee:  The Board directed staff to extend membership invitations to nursing program deans/directors in non-interim positions to participate in the committee.

  2. Discussion regarding questions posed by American Staffing- presentation by Bipin Patel:  American Staffing was represented by Bipin Patel, CEO; Rohit Patel, Senior Advisor; Robin Roche, Senior Advisor; Jeaneen McPherson, Controller; and David Carr.  Mr. Patel briefly described the mission, organization and challenges faced by American Staffing in recruiting qualified nurses from China, India and the United Arab Emirates.  These challenges revolve around the processing of international nursing graduates through the credentials evaluation process of CGFNS, the Bureau of Citizenship and Immigration Services, the Social Security Administration, and through the Board’s fingerprinting process.  Mr. Patel asked the Board to reconsider its requirement for the CGNFS-CES evaluation or at least allow education evaluations by other agencies.  He also asked the Board to accept an IRS Tax Identification Number in lieu of a social security number required by NRS 632.3443.   The Board president and Board counsel emphasized the Board’s mission of public protection describing the various processes and rationale currently in place to accomplish this mission.           

F.      NURSING PRACTICE

  1. Review of proposed practice decision regarding SANE:  D. Scott requested this agenda item be returned to the Nursing Practice Advisory Committee for further research with the expectation a recommendation will be brought forth at the next regularly scheduled Board meeting.

 

G.    SPECIAL ACTION:  No business.
