CALL TO ORDER

The Regular Meeting of the Nevada State Board of Nursing was called to order by the President, Patty Shutt, LPN, at 9:06 a.m. on September 22, 2004, at the Nevada State Museum and Historical Society, Twin Lakes Drive, Las Vegas, Nevada 89107

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Board Meeting, July 14-16, 2004:  Approved under the Consent Agenda. 

  2. Progress report on 04/05 priorities:  Presentation by D. Scott.  The goals reflect those approved by the Board at the July business meeting.  Activities of staff delineating actions related to the specific goals were presented. 

  3. Discussion and action regarding NSBN staff salary ranges:  Discussion by D. Scott and M. Flannigan. Discussion ensued regarding raising the lower and upper limits of the salary ranges of Board staff positions.  The Board also discussed and requested further research on cost of living and merit increases. It was moved and seconded the Board direct the Executive Director to increase the existing salary ranges for all employees by two steps.  It was moved and seconded the Board direct the Executive Director to raise any employee’s salary not now within the new range to the lowest step of that range, except for positions created in the last fiscal year.  MOTION CARRIED.

  4. Discussion related to risk management protection for Board Members:  Presentation by F. Olmstead and K. Marcher.  Discussion ensued to the purpose of the Tort Fund, its relation to Board members, and the protection it affords during the course of Board business.

  5. Discussion and action regarding utilization of a hearing officer:  Presentation by F. Olmstead.  The Nurse Practice Act authorizes the use of a hearing officer if the Board should elect to do so.  The advantages and disadvantages were discussed in detail.  Estimated costs associated with the use of a hearing officer were also presented.

  6. Discussion and action regarding nursing study by John Packham, Ph.D.:  Presentation by D. Scott.  An update was provided relative to the status of Dr. Packham’s latest survey related to Nevada’s nursing workforce.  It is anticipated the survey will provide valuable information relative to the nursing workforce in Nevada and that preliminary survey findings may be available as early as January 2005.

  7. Scheduling of Board meeting dates for 2005:  Presentation by P. Shutt and D. Scott.  The schedule for the next year as well as the benefits of single day Board meetings was discussed.   The schedule of dates concurred upon is:  January19-21; February 16; March 16-18; April 20; May18-20; June17; July13-15; September 14-16; October 26; and November 16-18.

  8. Discussion and action regarding Board member attendance at additional conferences: Presentation by D. Scott.  Discussion ensued relative to Board members attending professional meetings in addition to those scheduled for the year.  The Executive Director was directed to bring such requests to the Board President for decision.  It also directed that the annual conference schedule contain budgeted funds for Board member attendance at unscheduled meetings.

  9. Presentation of annual audit:  Presentation by D. Scott and M. Flannigan.  Discussion ensued relative to the change in auditor, the audit process, and the audit report and recommendations.  It was moved and seconded the Board accept the audit report.  MOTION CARRIED.

  1. Certified Nursing Assistants

a.       Ratification of Approved Nursing Assistant Training Programs (NATP): Approved under the Consent Agenda.

c.       Cole, Linda, CNA002135:  Respondent was present.  It was moved and seconded the Board find the Respondent guilty on the basis of the contents of the Stipulation of Facts and Liability received into evidence for violation of NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (17) soliciting or borrowing money from a patient and (34) misappropriating the property of a patient.  It was moved and seconded the Board order probation for a period of one year, which includes the stipulation that the Respondent may not practice in home health, long-term care, or work via an agency.  Respondent must take and successfully complete a Board- approved course in legal ethics in nursing for thirty (30) contact hours and complete the Professional Boundaries course presented by Board staff within one year.  It was moved and seconded the Board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

d.      Cork (Fitzgerald), Catherine, RN30105:  It was moved and seconded the Board accept the Voluntary Surrender of License in Lieu of Other Disciplinary Action for violation of NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (9) practicing nursing with or without good cause while impaired and (27) customary standards.  MOTION CARRIED.  H. e.       Devorss, Jennifer, LPN12141:  Respondent was not present.  Pursuant to NAC 632.923, it was moved and seconded the Board find the allegations of the complaint to be true, and find the Respondent guilty of violating NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (2) practicing beyond scope, (10) positive urine/drug screen on duty and (27) customary standards. It was moved and seconded the Board revoke Respondent’s license.  Respondent may not apply for reinstatement for a period of two (2) years.  Prior to reinstatement, Respondent must complete the Professional Boundaries course offered by Board staff, a non-home study legal ethics course, and have a psychiatric evaluation by a Board-approved provider.  It was moved and seconded the Board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to all appropriate agencies.  MOTION CARRIED.

f.        Dinwiddie, Jason, CNA017115:  It was moved and seconded the Board accept the Agreement for Probation for violation of NRS 632.320 (7) unprofessional conduct, and NAC 632.890 (11) positive urine/drug screen as a condition of employment. MOTION CARRIED.

g.       Fitzgerald, Cynthia, RN24142, CRNA000185:  Respondent was not present but was represented by counsel.  It was moved and seconded the Board accept the Stipulation to Immediately Cease Practicing as a Nurse and Nurse Anesthetist Pending a Formal Hearing Before the Board and continue the case until the January 2005 Board meeting.
