CALL TO ORDER

The Regular Meeting of the Nevada State Board of Nursing was called to order by the President, Patricia Shutt, LPN, at 9:00 a.m. on September 24, 2003, at the Grant Sawyer Building, Room 1100, 555 E. Washington, Las Vegas, Nevada  89101.

APPROVAL OF CONSENT AGENDA

It was moved and seconded the Board approve the Consent Agenda, identified as items A.1, A.11, C.1, D.2.a-g, i-j, l–dd, ff, D.3.a-c, D.7.a-b, d, h-i, D.8.a, d-e, g-h.  D. Perkins recused on D.2.cc.  H.Vos recused on D.2.y.  MOTION CARRIED.

 

A.     BOARD GOVERNANCE AND ADMINISTRATION

  1. Approval of minutes of Annual Board Retreat, July 23-25, 2003:  Approved under the Consent Agenda.

  2. Progress Report on FY03/04 Priorities:  Oral presentation by D. Scott, C. Kimball and D. Rennie.  At the Board’s retreat, FY03/04 priorities were established for governance and administration, nursing practice, discipline, education, licensure and certification. Information presented related to the new priorities included the increase in all CNA- related fees, the hiring of Board counsel, educational presentations by board staff, board committee actions and proposed regulatory changes related to LPN IV Therapy.

  3. Review and acceptance of FY 03 Annual Audit: Presentation by D. Scott and M. Flannigan. It was moved and seconded the Board approve the Kafoury-Armstrong & Company independent audit report dated June 30, 2003. MOTION CARRIED.

  4. Scheduling of Board meeting dates for 2004:  It was moved and seconded the Board schedule the following Board meeting dates for 2004:  January 21-23 (Las Vegas), February 20 (Las Vegas), March 31-April 2 (Reno), April 19 (Las Vegas), May 19-21 (Las Vegas), June 18 (Reno), July 14-16 (Las Vegas), September 22-24 (Las Vegas), October 25 (Reno), and November 17-19 (Reno).

  5. National Council of State Boards of Nursing:  Oral report from Delegate Assembly by C. Bible, M. Lambert, D. Scott, C. Sansom and P. Shutt.  At the meeting, C. Bible was presented the Exceptional Leadership Award and was reappointed to chair the Practice, Regulation, and Education Committee.  M. Lambert was appointed to the NCLEX Item Review and Analysis Committee.  D. Scott was appointed to the PR&E subcommittee on Model Rules. Overall, the attendees felt the meeting was a valuable format for the exchange of information and ideas with other member boards.  It was noted that four boards were recognized for 100 years of regulatory service to the public.

  6. Laws and regulations:  Public Hearing - Notice of Intent to Adopt Regulations

    a.       NAC 632.242 Additional duties in area of specialization:  It was moved and seconded the Board approve the proposed regulation as written.   MOTION CARRIED.

    b.      NAC 632.450 Procedures delegable to licensed practical nurses:  It was moved and seconded the Board approve the proposed regulation with the addition of steroids to subsection 1.e.  MOTION CARRIED.

    c.       NAC 632.455 Procedures not delegable to licensed practical nurses:  It was moved and seconded the Board approve the proposed regulation as written.  Clarification of terms hyperalimentation and TPN was referred to the Nursing Practice Advisory Committee for further study.  MOTION CARRIED.

  7. Annual review of statistics and trends:  Oral presentation by C. Sansom related to the trends of FY 02/03.  The majority of practice questions relate to scope of practice of RNs, LPNs, and CNAs.  It was noted there has been a slow but steady increase in the number of licensure applications that require additional Board involvement to complete processing.  No significant issues were noted during this last quarter.

  8.  Approval of concept and wording for:

    a.       NAC 632.600-711 Programs for education of nurses:  It was moved and seconded the Board approve the concept and wording as presented for change to NAC 632.600 as amended, 605 and 620 as amended, 645, 665, 703 and 706.  MOTION CARRIED.  It was moved and seconded the Board reject the proposed concept and wording as presented for change to NAC 632.708.  MOTION CARRIED.  The board tabled the discussion on the proposed concept and wording changes to NAC 632.625, 630, 670, 675 and 690.  The Board directed staff and the Education Advisory Committee to conduct further research on these particular regulations.

    b.      NAC 632.257 (2) (a) Requirement of 1,000 hours employment prior to applying for prescribing privileges:  The Board directed staff to obtain additional information from other boards of nursing and to survey newly certified APNs related to this requirement.

  9.  Preliminary review of FY 02/03 financial statement:  Oral presentation by D. Scott and M. Flannigan.  Per Board member request, additional information was presented related to budgetary revenue projections and actual expenses.  It was noted the long-term absence of a consumer Board member affected the projections related to Board member travel and associated expenses.

  10.  NSF check review FY 02/03:  Oral presentation by M. Flannigan.  Per Board member request, a comparison of two fiscal years (FY01/02 and FY02/03) was presented.  It was noted there was a slight increase in the number of NSF checks for the most recent FY.  It was also noted the dollar amounts written off as non-collectable are relatively small and manageable.  It was stated that an entry is made into the individual’s database licensure file when an NSF check is written off.

  11. Board ratification of contracts:  Approved under the Consent Agenda.

     

 

B.     LICENSURE PROGRAMS

  1. Discussion of Issuance of Temporary and Permanent License/Certification by Endorsement Policy and Procedure:  Oral presentation by D. Rennie.  Under current policies RNs, LPNs, and CNAs could theoretically obtain a temporary license/certificate annually without completing all the required background checks.  It was moved and seconded the Board approve the proposed policy changes as amended.  MOTION CARRIED

 

C.     CERTIFICATION PROGRAMS

  1. Approval of Nursing Assistant Training Program Survey, June-August 2003: Approved under the Consent Agenda.

  2. Appointment to the CNA Advisory Committee:  It was moved and seconded the Board appoint Catherine Johnson, RN, to the CNA Advisory Committee.  MOTION CARRIED.

5.      Formal administrative hearings:

a.       Arnold, Mary, RN07764:  It was moved and seconded the Board continue the hearing until the next available Board meeting in Las Vegas, with continuance of the practice restrictions previously ordered by the Board that she not practice or represent herself as a registered nurse. MOTION CARRIED.

b.      Barrett, Leslie, CNA016431:  It was moved and seconded the Board continue the hearing until the next available Board meeting in Las Vegas. MOTION CARRIED.

c.       Battey, Peter, CNA005311:  Respondent was present with counsel.  It was moved and seconded the Board accept the Voluntary Surrender of License/Certificate in Lieu of Other Disciplinary Action for violation of NRS 632.320 (7) unprofessional conduct, NAC 632.890 (10) positive urine/drug screen and (27) customary standards.  MOTION CARRIED.

d.      Bayless, Sherman, LPN08194:  It was moved and seconded the Board find the Respondent guilty on the basis of the contents in the Stipulation of Facts and Liability that was received into evidence.  MOTION CARRIED.  It was moved and seconded the Board revoke the Respondent’s licensure for two (2) years based on violation of NRS 632.320 (14) failure to comply with an order of the Board. Respondent must complete the previously ordered course prior to applying for reinstatement.   MOTION CARRIED

e.       Casaus, Cheryl, LPN11178:  It was moved and seconded the Board find the Respondent guilty of one count of NRS 632. 320 (7) unprofessional conduct and NAC 632.890 (35) failing to comply with a Board order. MOTION CARRIED.  It was moved and seconded the Board suspend the Respondent’s license until she completes the terms of her previous agreement, completes an evaluation by the Board’s Disability Advisory Committee, and appears before the Board.  MOTION CARRIED.  It was moved and seconded the Board order the disciplinary action become part of the Respondent's permanent record and be published and reported to all appropriate agencies. MOTION CARRIED.  Pursuant to NRS 632.325(1)(c), it was moved and seconded the Board charge the Respondent with the actual costs of this hearing including the costs incurred which are related to any assistance received from the Office of the Attorney General and payable within one hundred twenty (120) days from issuance of the actual costs. MOTION CARRIED

f.        Cilley, Eric, RN41221:  Respondent was present.  It was moved and seconded the Board accept the Voluntary Surrender of License/Certificate in Lieu of Other Disciplinary Action for violation of NRS 632.320 (7) unprofessional conduct and NAC 632.890 (9) practicing while impaired, (16) failing to properly document narcotics, and (27) customary standards.  MOTION CARRIED.

g.       Cullpepper, Charles, RN33529:  Respondent was present.  It was moved and seconded the Board find the Respondent guilty based on the contents of Respondent’s stipulation to the contents of the Formal Complaint. MOTION CARRIED.  It was moved and seconded the Board revoke the Respondent’s licensure for three (3) years for violation of NRS 632.320 (7) unprofessional conduct and NAC 632.890 (35) failing to comply with condition, limitation or restriction of the Board. MOTION CARRIED. It was moved and seconded the Board order the disciplinary action become part of the Respondent’s permanent record and be published and reported to the appropriate agencies.  MOTION CARRIED.

E.     EDUCATION 

  1. Report on Apprentice Nursing Program survey:  Oral presentation by D. Rennie.  A survey of facilities having an Apprentice Nurse Program indicates the majority consider the program to be a beneficial partnership in the development of the student related to skill proficiency.  It was also noted the majority expressed interest in opening the program to out-of-state students.   The Board directed staff to explore the development of a similar program for practical nursing students. The Board directed staff to advise facilities of the process and responsibilities related to hiring out-of-state students as Apprentice Nurses.

  2. Appointments to Education Advisory Committee:  It was moved and seconded the Board appoint Ann Marie DiLisio, RN, to the Education Advisory Committee.  MOTION CARRIED.

  3. Discussion of approval/accreditation process:  Oral presentation by D. Scott, D. Rennie and F. Olmstead.  The processes and significance of a nursing program obtaining a board of nursing approval status and a national accreditation status were discussed related to initial licensure and endorsement licensure.  Discussion ensued relative to the evaluation of a nursing program for compliance with the requirements set forth in Nevada statute and regulation.  The Board directed staff to continue to accept accreditation/approval of programs based on accreditation/approval by other boards of nursing.  The Board directed the Executive Director to send letters of concern to the NLNAC, NCSBN and the State of New York-Department of Education related to said accreditation/approval processes.

F.      NURSING PRACTICE

  1. Review of proposed practice decision regarding vein harvesting:  It was moved and seconded the Board approve the proposed practice decision revision as written.  MOTION CARRIED.

  2. Review of proposed practice decision regarding SANE:  Oral presentation by D. Scott.  Representatives of the International Association of Forensic Nurses (IAFN) spoke to the need for specialized training allowing nurses to perform evaluation and physical examinations in an interdependent relationship with a physician.  The IAFN representatives felt this would be within the scope of practice of the RN.  Concerns were raised that there is currently no specific SANE certification for pediatrics available for RNs.  Other pertinent issues discussed included acute versus chronic abuse, lack of a time frame for the RN to obtain certification, and the extension of the period of acute evaluation from 3 to up to 7 days due to more sophisticated testing of specimens.  The Board directed the proposed practice decision be returned to the Nursing Practice Advisory Committee for further research and that key personnel be invited to participate in the further development of this proposal.

 

G.    SPECIAL ACTION

  1. Request to address Board by Bridge Staffing:  John Pehler requested the Board consider the efforts made by Bridge Staffing in attempting to ensure 28 licensure applications were at the Board office by close of business on July 31, 2003.  Board staff had rejected the applications citing the August 1, 2003, deadline for implementing the policy to obtain CES certificates from all international graduates.  It was moved and seconded the Board accept the 28 applications from Bridge Staffing for processing under the previous evaluation system due to the applications being delivered to the office by August 1, 2003.  MOTION CARRIED.
